Mai jos, g\u0103si\u0163i o expunere comparativ\u0103 a diferitelor texte:<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/HTML\/?uri=CELEX:32016L0343&amp;from=EN\"><span style=\"font-weight: 400;\">Textul Directivei 343\/2016<\/span><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b>Articolul 4 &#8211; Referirile publice la vinov\u0103\u021bie<\/b><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(1) &nbsp;&nbsp;Statele membre iau m\u0103surile necesare pentru a garanta c\u0103, <\/span><b>at\u00e2ta vreme c\u00e2t vinov\u0103\u021bia unei persoane suspectate sau acuzate nu a fost dovedit\u0103 conform legii, declara\u021biile publice f\u0103cute de autorit\u0103\u021bile publice \u0219i deciziile judiciare, altele dec\u00e2t cele referitoare la vinov\u0103\u021bie, nu se refer\u0103 la persoana respectiv\u0103 ca fiind vinovat\u0103<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">[&#8230;]<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(3) &nbsp;<\/span><b>&nbsp;Obliga\u021bia prev\u0103zut\u0103 la alineatul (1) <\/b><span style=\"font-weight: 400;\">de a nu se referi la persoane suspectate sau acuzate ca \u0219i cum ar fi vinovate<\/span><b> nu \u00eempiedic\u0103 autorit\u0103\u021bile publice s\u0103 difuzeze informa\u021bii \u00een mod public privind procedurile penale atunci c\u00e2nd acest lucru este strict necesar din motive legate de ancheta penal\u0103 sau \u00een interes public.<\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Legisla\u0163ia \u00een vigoare<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/197771http:\/\/legislatie.just.ro\/Public\/DetaliiDocumentAfis\/197771\"><span style=\"font-weight: 400;\">Codul de Procedur\u0103 Penal\u0103<\/span><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Articolul 4 &#8211; Prezum\u021bia de nevinov\u0103\u021bie<\/span><span style=\"font-weight: 400;\"><br><\/span><b>(1) Orice persoan\u0103 este considerat\u0103 nevinovat\u0103 p\u00e2n\u0103 la stabilirea vinov\u0103\u021biei sale printr-o hot\u0103r\u00e2re penal\u0103 definitiv\u0103.<\/b><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(2) Dup\u0103 administrarea \u00eentregului probatoriu, orice \u00eendoial\u0103 \u00een formarea convingerii organelor judiciare se interpreteaz\u0103 \u00een favoarea suspectului sau inculpatului.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/www.cdep.ro\/comisii\/suasl_justitie\/pdf\/2017\/rd_1215.pdf\"><span style=\"font-weight: 400;\">Amendamentele propuse \u00een Comisie<\/span><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\"> La articolul 4, dup\u0103 alineatul (2) se introduc dou\u0103 noi alineate, alin. (3) \u0219i (4) cu urm\u0103torul cuprins: <\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(3) \u00cen cursul urm\u0103ririi penale \u0219i al judec\u0103rii cauzei \u00een procedur\u0103 de camer\u0103 preliminar\u0103 <\/span><b>sunt interzise comunic\u0103rile publice, declara\u021biile publice precum \u0219i furnizarea de alte informa\u021bii, direct sau indirect, provenind de la autorit\u0103\u021bi publice sau orice alte persoane fizice sau juridice referitoare la faptele \u0219i persoanele ce fac obiectul acestor proceduri.<\/b><span style=\"font-weight: 400;\"> \u00cenc\u0103lcarea acestei obliga\u021bii reprezint\u0103 infrac\u021biune \u0219i se pedepse\u0219te, potrivit legii penale.<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(4) \u00cen cursul procesului penal este interzis\u0103 prezentarea public\u0103 a persoanelor suspectate de s\u0103v\u00e2r\u0219irea unor infrac\u021biuni purt\u00e2nd c\u0103tu\u0219e sau alte mijloace de imobilizare sau afectate de alte modalit\u0103\u021bi de natur\u0103 a induce \u00een percep\u021bia public\u0103 c\u0103 acestea ar fi vinovate de s\u0103v\u00e2r\u0219irea unor infrac\u021biuni.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Relu\u00e2nd observa\u0163iile f\u0103cute <\/span><a href=\"https:\/\/www.factual.ro\/declaratii\/florin-iordache-nu-depasesc-cadrul-directivei-europene\/\"><span style=\"font-weight: 400;\">aici<\/span><\/a><span style=\"font-weight: 400;\">, observ\u0103m c\u0103 Directiva a solicitat Rom\u00e2niei s\u0103 se asigure c\u0103 rom\u00e2nii nu vor fi numi\u021bi infractori \u00eentr-un document oficial f\u0103r\u0103 s\u0103 treac\u0103 printr-un proces echitabil &#8211; obliga\u0163ie deja prev\u0103ut\u0103 \u00een Codul de Procedu\u0103 Penal\u0103, dup\u0103 cum am ar\u0103tat mai sus. <\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">\u00cen schimb modific\u0103rile propuse de PSD-ALDE \u00een comisia special\u0103 vorbesc despre modul \u00een care sunt comunicate detaliile despre anchetele penale. Adic\u0103 <\/span><i><span style=\"font-weight: 400;\">au extins prevederile directivei de la asigurarea prezum\u021biei de nevinov\u0103\u021bie la modul \u00een care publicul este informat.<\/span><\/i><span style=\"font-weight: 400;\"> Modificarea propus\u0103 prevede faptul c\u0103 devine infrac\u021biune comunicare public\u0103 a informa\u021biilor legate de dosarele penale aflate \u00een faza investiga\u021biilor. Formularea este vag\u0103 \u0219i nu precizeaz\u0103 la cine se refer\u0103 astfel c\u0103 putem concluziona c\u0103 este vorba de orice persoan\u0103 sau institu\u021bie. Directiva spune exact pe dos: <\/span><i><span style=\"font-weight: 400;\">anume c\u0103 autorit\u0103\u021bile au dreptul s\u0103 informeze publicul despre investiga\u021biile penale; pentru asta exist\u0103 codul aprobat de Consiliul Superior al Magistraturii care are \u00een vedere protejarea prezum\u021biei de nevinov\u0103\u021bie.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">De asemenea, Directiva face referire doar la obliga\u021bia autorit\u0103\u021bilor publice care ar pune eticheta de \u201dvinovat\u201d, \u00een vreme ce amendamentele propuse instituie aceast\u0103 obliga\u021bie tuturor persoanelor fizice \u0219i juridice.<\/span><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li><b> Dreptul la informare<\/b><\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Dup\u0103 cum am v\u0103zut mai sus, acest drept fundamental este cuprins \u00een Constitu\u0163ia Rom\u00e2niei, iar Directiva 343\/2016 include o l\u0103murire \u00een acest sens.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Informarea \u00een interes public este, de altfel, invocat\u0103 \u015fi \u00een <\/span><a href=\"http:\/\/www.pna.ro\/comunicat.xhtml?id=8547\"><span style=\"font-weight: 400;\">comunicatul de pres\u0103 al DNA<\/span><\/a><span style=\"font-weight: 400;\"> asupra transpunerii Directivei (pozi\u0163ia este reluat\u0103 <\/span><a href=\"http:\/\/www.pna.ro\/comunicat.xhtml?id=8700\"><span style=\"font-weight: 400;\">aici<\/span><\/a><span style=\"font-weight: 400;\">):<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i><span style=\"font-weight: 400;\">Aceste modific\u0103ri <\/span><\/i><span style=\"font-weight: 400;\">[asupra CPP, n.n]<\/span><i><span style=\"font-weight: 400;\"> vor avea un efect devastator asupra anchetelor penale, deoarece elimin\u0103 instrumentele legale indispensabile prin care organele de anchet\u0103 pot investiga infrac\u021biunile.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">\u00cen realitate toate garan\u021biile pe care le implic\u0103 Directiva (UE) 2016\/343 a Parlamentului European \u0219i a Consiliului din 09.03.2016 sunt deja prev\u0103zute \u00een legisla\u021bia intern\u0103.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">A\u0219adar, Directiva este folosit\u0103 doar ca un pretext pentru a elimina capacitatea organelor de urm\u0103rire penal\u0103 de a descoperi \u0219i de a dovedi infrac\u021biuni, iar scopul acestor modific\u0103ri nu are nicio leg\u0103tur\u0103 cu prezum\u021bia de nevinov\u0103\u021bie.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">Astfel, [&#8230;] I<\/span><\/i><b><i>ntroducerea art.4 alin.3, 4 Cod procedur\u0103 penal\u0103 realizeaz\u0103 o evident\u0103 discriminare \u00eentre autorii unor infrac\u021biuni \u0219i dreptul publicului de a avea acces la informa\u021bii de interes public<\/i><\/b><i><span style=\"font-weight: 400;\">. Aceste reglement\u0103ri contravin jurispruden\u021bei constante a Cur\u021bii Europene a Drepturilor Omului (CEDO), Recomand\u0103rii (2003) 13 a Comitetului Mini\u0219trilor al Consiliului Europei, Rezolu\u021biei nr.428\/1970 adoptat\u0103 de Adunarea Parlamentar\u0103 a Consiliului Europei privind obliga\u021bia statelor de a asigura accesul oric\u0103rei persoane interesate \u0219i mass-media la informa\u021bii de interes public. <\/span><\/i><b><i>Cercet\u0103rile efectuate \u00een cauze de corup\u021bie, sp\u0103lare de bani, evaziune fiscal\u0103, cauze de violen\u021b\u0103 etc reprezint\u0103 informa\u021bii de interes public, a\u0219a \u00eenc\u00e2t, restric\u021bia echivaleaz\u0103 cu \u00eenc\u0103lcarea dreptului publicului de a avea acces la informa\u021bii publice.<\/i><\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Modul \u00een care se face comunicarea \u00een interes public este elaborat\u0103 \u00een <\/span><a href=\"http:\/\/old.csm1909.ro\/csm\/linkuri\/20_05_2014__67404_ro.doc\"><span style=\"font-weight: 400;\">Ghidul privind rela\u0163ia dintre sistemul judiciar din Rom\u00e2nia \u015fi mass-media<\/span><\/a><span style=\"font-weight: 400;\"> (CSM): <\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Art. 25 &#8211; (1) Comunicarea de informa\u0163ii privind stadiul actelor de cercetare reprezentan\u0163ilor mass-media poate fi f\u0103cut\u0103 numai dup\u0103 ce exist\u0103 suspect \u00een cauz\u0103. Dac\u0103 fapta ce formeaz\u0103 obiectul dosarului penal prezint\u0103 un grad de pericol social ridicat sau justific\u0103 un interes deosebit pentru public pot fi comunicate informa\u0163ii despre \u00eenceperea urm\u0103ririi penale cu privire la fapt\u0103 \u015fi m\u0103surile dispuse \u00een cauz\u0103 \u00een vederea identific\u0103rii f\u0103ptuitorului sau pentru str\u00e2ngerea probelor, cu excep\u0163ia situa\u0163iei \u00een care prin transmiterea acestor informa\u0163ii s-ar periclita rezultatul anchetei.<\/span><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">(2) <\/span><b>Informa\u0163iile men\u0163ionate la alin. (1) se refer\u0103 la urm\u0103toarele aspecte: s-a \u00eenceput urm\u0103rirea penal\u0103, s-a pus \u00een mi\u015fcare ac\u0163iunea penal\u0103, s-a luat m\u0103sura re\u0163inerii, s-a solicitat instan\u0163ei competente luarea\/prelungirea m\u0103surilor preventive, s-a finalizat urm\u0103rirea penal\u0103, s-a dispus o solu\u0163ie de netrimitere \u00een judecat\u0103, s-a dispus trimiterea \u00een judecat\u0103, fiind \u00eentocmit \u015fi \u00eenaintat rechizitoriul c\u0103tre instan\u0163\u0103. Comunicatele sau comunic\u0103rile de informa\u0163ii la cerere pot cuprinde \u015fi informa\u0163ii cu privire la persoana fa\u0163\u0103 de care m\u0103surile au fost dispuse, fapta re\u0163inut\u0103 \u015fi \u00eencadrarea juridic\u0103 a acesteia \u015fi motivele care au determinat adoptarea solu\u0163iei sau luarea m\u0103surii respective.<\/b><b><br><\/b><span style=\"font-weight: 400;\"><br><\/span><span style=\"font-weight: 400;\">\u00cen concluzie, legisla\u0163ia rom\u00e2neasc\u0103 deja ap\u0103r\u0103 prezum\u0163ia de neviov\u0103\u0163ie, dup\u0103 cum reiese din sursele de mai sus, dar \u015fi dreptul la informare.<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><b>DNA S\u0102 VIN\u0102 S\u0102 V\u0102 IA \/ DNA TREBUIE S\u0102 REZOLVE TOATE PROBLEMELE <\/b><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">DNA se bucur\u0103 de vizibilitate \u00een media \u015fi \u00een con\u015ftiin\u0163a public\u0103 &#8211; uneori, Direc\u0163ia Na\u0163ional\u0103 Anticorup\u0163ie este privit\u0103 ca un panaceu. <\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b><i>Trebuie DNA s\u0103 rezolve toate problemele cu care ne confrunt\u0103m?<\/i><\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Vecinul folose\u015fte borma\u015fina duminic\u0103 la 8 diminea\u0163a? Nu pare a fi de competen\u0163a DNA.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Dar dac\u0103 acela\u015fi vecin i-a f\u0103cut un cadou administratorului ca acesta s\u0103 ignore pl\u00e2ngerile legate de folosirea borma\u015finii? S\u0103 vin\u0103 DNA s\u0103-l ia?<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">C\u00e2nd putem apela la DNA \u015fi ce atribu\u0163ii are?<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Pentru \u00eenceput, vom consulta site-ul DNA, sec\u0163iunea <\/span><a href=\"http:\/\/www.pna.ro\/about_us.xhtml\"><i><span style=\"font-weight: 400;\">cu ce se ocup\u0103 DNA?<\/span><\/i><\/a><span style=\"font-weight: 400;\">:<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><b><i>DNA desf\u0103\u0219oar\u0103 urm\u0103rirea penal\u0103 pentru infrac\u021biuni de corup\u021bie, asimilate \u0219i \u00een leg\u0103tur\u0103 direct\u0103 cu acestea. Modific\u0103rile succesive ale legisla\u021biei au vizat ca aceast\u0103 structur\u0103 specializat\u0103 s\u0103 se ocupe numai de combaterea faptelor de corup\u021bie de nivel \u00eenalt \u0219i mediu.<\/i><\/b><i><span style=\"font-weight: 400;\"> De asemenea, DNA investigheaz\u0103 infrac\u021biuni \u00eempotriva intereselor financiare ale Comunit\u0103\u021bilor Europene precum \u0219i anumite categorii de infrac\u021biuni grave de criminalitate economico-financiar\u0103.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">Care sunt categoriile de infrac\u021biuni aflate \u00een competen\u021ba DNA<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">a) <\/span><\/i><span style=\"font-weight: 400;\">infrac\u021biuni de corup\u021bie:<\/span><i><span style=\"font-weight: 400;\"> luarea \u0219i darea de mit\u0103, traficul de influen\u021b\u0103, primirea de foloase necuvenite;<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">b) <\/span><\/i><span style=\"font-weight: 400;\">infrac\u021biuni asimilate celor de corup\u021bie<\/span><i><span style=\"font-weight: 400;\">: stabilirea unei valori diminuate a bunurilor apar\u021bin\u00e2nd operatorilor economici la care statul sau o autoritate a administra\u021biei publice locale este ac\u021bionar, comis\u0103 inclusiv \u00een cadrul ac\u021biunii de executare silit\u0103, reorganizare sau lichidare judiciar\u0103; acordarea de credite sau de subven\u021bii cu \u00eenc\u0103lcarea legii sau a normelor de creditare; utilizarea creditelor sau a subven\u021biilor \u00een alte scopuri dec\u00e2t cele pentru care au fost acordate; folosirea unei func\u021bii de conducere \u00eentr-un partid, sindicat sau patronat ori \u00een cadrul unei persoane juridice f\u0103r\u0103 scop patrimonial, pentru a ob\u021bine foloase necuvenite etc.;<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">c) <\/span><\/i><span style=\"font-weight: 400;\">infrac\u021biuni \u00een leg\u0103tur\u0103 direct\u0103 cu infrac\u021biunile de corup\u021bie:<\/span><i><span style=\"font-weight: 400;\"> t\u0103inuirea bunurilor provenite din s\u0103v\u00e2r\u0219irea unei infrac\u021biuni de corup\u021bie sau asimilate; sp\u0103larea banilor; abuzul \u00een serviciu; bancruta frauduloas\u0103; evaziunea fiscal\u0103; traficul de droguri; trafic de persoane \u0219.a.;<\/span><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Vom avea \u00een vedere \u015fi ordonan\u0163a prin care a fost \u00eenfiin\u0163at DNA (pe atunci, PNA) <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/35165\"><span style=\"font-weight: 400;\">OUG 43\/2002<\/span><\/a><span style=\"font-weight: 400;\">, cu actualiz\u0103ril de rigoare; la <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/35165#id_capA615_ttl\"><span style=\"font-weight: 400;\">Capitolul III<\/span><\/a><span style=\"font-weight: 400;\">, afl\u0103m care sunt competen\u0163ele DNA:<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><i><span style=\"font-weight: 400;\">Articolul 13<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(1) Sunt de competen\u0163a Direc\u0163iei Na\u0163ionale Anticorup\u0163ie infrac\u0163iunile prev\u0103zute \u00een <\/span><\/i><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/22361\"><i><span style=\"font-weight: 400;\">Legea nr. 78\/2000<\/span><\/i><\/a><i><span style=\"font-weight: 400;\">, cu modific\u0103rile \u015fi complet\u0103rile ulterioare, s\u0103v\u00e2r\u015fite \u00een una dintre urm\u0103toarele <\/span><\/i><b><i>condi\u0163ii<\/i><\/b><i><span style=\"font-weight: 400;\">:<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">a) dac\u0103, indiferent de calitatea persoanelor care le-au comis, <\/span><\/i><b><i>au cauzat o pagub\u0103 material\u0103 mai mare dec\u00e2t echivalentul \u00een lei a 200.000 euro ori dac\u0103 valoarea sumei sau a bunului care formeaz\u0103 obiectul infrac\u0163iunii de corup\u0163ie este mai mare dec\u00e2t echivalentul \u00een lei a 10.000 euro<\/i><\/b><i><span style=\"font-weight: 400;\">;<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">b) dac\u0103, indiferent de valoarea pagubei materiale ori de valoarea sumei sau a bunului care formeaz\u0103 obiectul infrac\u0163iunii de corup\u0163ie, sunt comise de c\u0103tre: deputa\u0163i; senatori; membrii din Rom\u00e2nia ai Parlamentului European; membrul desemnat de Rom\u00e2nia \u00een Comisia European\u0103; membri ai Guvernului, secretari de stat ori subsecretari de stat \u015fi asimila\u0163ii acestora; consilieri ai mini\u015ftrilor; judec\u0103torii \u00cenaltei Cur\u0163i de Casa\u0163ie \u015fi Justi\u0163ie \u015fi ai Cur\u0163ii Constitu\u0163ionale; ceilal\u0163i judec\u0103tori \u015fi procurori; membrii Consiliului Superior al Magistraturii; pre\u015fedintele Consiliului Legislativ \u015fi loc\u0163iitorul acestuia; Avocatul Poporului \u015fi adjunc\u0163ii s\u0103i; consilierii preziden\u0163iali \u015fi consilierii de stat din cadrul Administra\u0163iei Preziden\u0163iale; consilierii de stat ai prim-ministrului; membrii \u015fi auditorii publici externi din cadrul Cur\u0163ii de Conturi a Rom\u00e2niei \u015fi ai camerelor jude\u0163ene de conturi; guvernatorul, prim-viceguvernatorul \u015fi viceguvernatorii B\u0103ncii Na\u0163ionale a Rom\u00e2niei; pre\u015fedintele \u015fi vicepre\u015fedintele Consiliului Concuren\u0163ei; ofi\u0163eri, amirali, generali \u015fi mare\u015fali; ofi\u0163eri de poli\u0163ie; pre\u015fedin\u0163ii \u015fi vicepre\u015fedin\u0163ii consiliilor jude\u0163ene; primarul general \u015fi viceprimarii municipiului Bucure\u015fti; primarii \u015fi viceprimarii sectoarelor municipiului Bucure\u015fti; primarii \u015fi viceprimarii municipiilor; consilieri jude\u0163eni; prefec\u0163i \u015fi subprefec\u0163i; conduc\u0103torii autorit\u0103\u0163ilor \u015fi institu\u0163iilor publice centrale \u015fi locale \u015fi persoanele cu func\u0163ii de control din cadrul acestora, cu excep\u0163ia conduc\u0103torilor autorit\u0103\u0163ilor \u015fi institu\u0163iilor publice de la nivelul ora\u015felor \u015fi comunelor \u015fi a persoanelor cu func\u0163ii de control din cadrul acestora; avoca\u0163i; comisarii G\u0103rzii Financiare; personalul vamal; persoanele care de\u0163in func\u0163ii de conducere, de la director inclusiv, \u00een cadrul regiilor autonome de interes na\u0163ional, al companiilor \u015fi societ\u0103\u0163ilor na\u0163ionale, al b\u0103ncilor \u015fi al societ\u0103\u0163ilor comerciale la care statul este ac\u0163ionar majoritar, al institu\u0163iilor publice care au atribu\u0163ii \u00een procesul de privatizare \u015fi al unit\u0103\u0163ilor centrale financiar-bancare; persoanele prev\u0103zute la art. 293 \u015fi 294 din Codul penal.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(2) Infrac\u0163iunile \u00eempotriva intereselor financiare ale Uniunii Europene sunt de competen\u0163a Direc\u0163iei Na\u0163ionale Anticorup\u0163ie.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(3) Sunt de competen\u0163a Direc\u0163iei Na\u0163ionale Anticorup\u0163ie infrac\u0163iunile prev\u0103zute la art. 246, 297 \u015fi 300 din Codul penal, dac\u0103 s-a cauzat o pagub\u0103 mai mare dec\u00e2t echivalentul \u00een lei a 1.000.000 euro.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(4) Procurorii din cadrul Direc\u0163iei Na\u0163ionale Anticorup\u0163ie efectueaz\u0103 \u00een mod obligatoriu urm\u0103rirea penal\u0103 pentru infrac\u0163iunile prev\u0103zute la alin. (1)-(3).<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(5) \u00cen cazul \u00een care dispune disjungerea \u00een cursul urm\u0103ririi penale, procurorul din cadrul Direc\u0163iei Na\u0163ionale Anticorup\u0163ie poate continua efectuarea urm\u0103ririi penale \u015fi \u00een cauza disjuns\u0103.<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">(6) Urm\u0103rirea penal\u0103 \u00een cauzele privind infrac\u0163iunile prev\u0103zute la alin. (1)-(3), s\u0103v\u00e2r\u015fite de militarii \u00een activitate, se efectueaz\u0103 de procurori militari din cadrul Direc\u0163iei Na\u0163ionale Anticorup\u0163ie, indiferent de gradul militar pe care \u00eel au persoanele cercetate.<\/span><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Practic, DNA se ocup\u0103 cu:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">luare \u015fi dare de mit\u0103<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">trafic de influen\u0163\u0103<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">primirea de foloase necuvenite<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">sp\u0103larea banilor <\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">abuzul \u00een serviciu <\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">evaziunea fiscal\u0103<\/span><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Dar DNA nu se ocup\u0103 cu:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">furturi din buzunar<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">b\u0103t\u0103ile din baruri<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">accidente auto<\/span><\/li><li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">un pachet de cafea dat secretarei de la facultate<\/span><\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Care sunt \u00eens\u0103 situa\u0163iile mai ambigue \u00een care ne putem \u00eentreba dac\u0103 o fapt\u0103 este sau nu e competen\u0163a DNA?<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Vom consulta dou\u0103 decizii ale CCR: <\/span><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li style=\"font-weight: 400;\"><a href=\"https:\/\/www.ccr.ro\/files\/products\/decizia_68+opinie.pdf\"><span style=\"font-weight: 400;\">Decizia nr. 68 din 27 februarie 2017 referitoare la cererea de solu\u0163ionare a conflictului juridic de natur\u0103 constitu\u0163ional\u0103 dintre Guvernul Rom\u00e2niei \u0219i Ministerul Public &#8211; Parchetul de pe l\u00e2ng\u0103 \u00cenalta Curte de Casa\u0163ie \u015fi Justi\u0163ie &#8211; Direc\u021bia Na\u021bional\u0103 Anticorup\u021bie<\/span><\/a><span style=\"font-weight: 400;\">, din care afl\u0103m c\u0103 DNA nu are atribu\u0163ii legate de verificarea legalit\u0103\u0163ii \u015fi oportunit\u0103\u0163ii unui act normativ (aici, OUG 13)<\/span><\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><i><span style=\"font-weight: 400;\">[CCR] constat\u0103 c\u0103 a existat \u0219i exist\u0103 un conflict juridic de natur\u0103 constitu\u021bional\u0103 \u00eentre Ministerul Public \u2013 Parchetul de pe l\u00e2ng\u0103 \u00cenalta Curte de Casa\u0163ie \u015fi Justi\u0163ie &#8211; Direc\u021bia<\/span><\/i><i><span style=\"font-weight: 400;\"><br><\/span><\/i><i><span style=\"font-weight: 400;\">Na\u021bional\u0103 Anticorup\u021bie \u0219i Guvernul Rom\u00e2niei, generat de ac\u021biunea Parchetului de pe l\u00e2ng\u0103 \u00cenalta Curte de Casa\u0163ie \u015fi Justi\u0163ie &#8211; Direc\u021bia Na\u021bional\u0103 Anticorup\u021bie de a-\u0219i aroga atribu\u021bia de a verifica legalitatea \u0219i oportunitatea unui act normativ, respectiv Ordonan\u021ba de urgen\u021b\u0103 57 a Guvernului nr.13\/2017, cu \u00eenc\u0103lcarea competen\u021belor constitu\u021bionale ale Guvernului \u0219i Parlamentului, prev\u0103zute de art.115 alin.(4) \u0219i (5) din Constitu\u021bie, respectiv ale Cur\u021bii Constitu\u021bionale, prev\u0103zute de art.146 lit.d) din Constitu\u021bie.<\/span><\/i><\/p>\n\n\n\n<ol class=\"wp-block-list\"><li style=\"font-weight: 400;\"><a href=\"https:\/\/www.ccr.ro\/files\/products\/Decizie_757_2017.pdf\"><span style=\"font-weight: 400;\">DECIZIA nr. 757 din 23 noiembrie 2017 asupra cererii de solu\u021bionare a conflictului juridic de natur\u0103 constitu\u021bional\u0103 dintre Guvernul Rom\u00e2niei, pe de o parte, \u0219i Ministerul Public \u2014 Parchetul de pe l\u00e2ng\u0103 \u00cenalta Curte de Casa\u021bie \u0219i Justi\u021bie, Direc\u021bia Na\u021bional\u0103 Anticorup\u021bie, pe de alt\u0103 parte<\/span><\/a><span style=\"font-weight: 400;\">, din care re\u0163inem c\u0103, \u00een anumite circumstan\u0163e, legalitatea actelor normetive poate fi verificat\u0103 de instan\u0163a penal\u0103, anume DNA \u00een acest caz: <\/span><\/li><\/ol>\n\n\n\n<p class=\"wp-block-paragraph\"><i><span style=\"font-weight: 400;\">A\u0219adar, Curtea re\u021bine c\u0103, de principiu, <\/span><\/i><b><i>competen\u021ba cercet\u0103rii legalit\u0103\u021bii actelor<\/i><\/b><b><i><br><\/i><\/b><b><i>administrative apar\u021bine instan\u021bei de contencios administrativ \u0219i numai cu titlu incidental acestea pot fi cercetate de instan\u021ba care judec\u0103 \u00een materie penal\u0103 \u00een m\u0103sura \u00een care \u00een cauz\u0103 este adus\u0103 o acuza\u021bie \u00een materie penal\u0103 cu privire la acte\/fapte s\u0103v\u00e2r\u0219ite \u00een leg\u0103tur\u0103 cu emiterea actului respectiv<\/i><\/b><i><span style=\"font-weight: 400;\">. De aceea, nu poate fi acceptat\u0103 nici sus\u021binerea potrivit c\u0103reia aceast\u0103 din urm\u0103 instan\u021b\u0103 se substituie celei de contencios administrativ, \u00eentruc\u00e2t obiectul principal al judec\u0103\u021bii sale este diferit, acesta av\u00e2nd un alt scop\/obiectiv.<\/span><\/i><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Din cele dou\u0103 decizii CCR putem \u00een\u0163elege urm\u0103toarele: DNA poate, spre exemplu, s\u0103 cerceteze incidental legalitatea unei ordonan\u0163e pentru a construi o autostrad\u0103 dac\u0103 exist\u0103 suspiciuni rezonabile c\u0103 de ordonan\u0163a respectiv\u0103 se leag\u0103 darea de \u015fpag\u0103 sau c\u0103 s-a f\u0103cut trafic de influen\u0163\u0103, dat fiind faptul c\u0103 traseul autostr\u0103zii a fost modificat ca s\u0103 treac\u0103 pe terenurile proasp\u0103t cump\u0103rate de un ministru, care ar primi desp\u0103ubiri. A\u0219adar, DNA nu constat\u0103 dac\u0103 ordonan\u021ba este legal\u0103 sau nu, ci dac\u0103 s-a dat sau nu o \u0219pag\u0103 pentru o ordonan\u021b\u0103. \u00cen schimb, o ordonan\u0163\u0103 de construire a unei autostr\u0103zi care pur \u015fi simplu are un traseu prost g\u00e2ndit nu are leg\u0103tur\u0103 cu competen\u0163ele DNA.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">\u00cen concluzie, competen\u0163ele DNA se rezum\u0103 la cadrul legal pe care l-am expus anterior; \u00een linii mari, putem spune c\u0103 se ocup\u0103 de combaterea faptelor de corup\u021bie de nivel \u00eenalt \u0219i mediu.<\/span><\/p>\n\n\n\n<hr class=\"wp-block-separator\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><b>DNA H\u0102R\u0162UIE\u015eTE PSD<\/b><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\"><b><i>Ac\u0163iunile DNA vizeaz\u0103 aproape exclusiv membri ai PSD?<\/i><\/b><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Am vrut s\u0103 vedem care este distribu\u0163ia persoanelor pentru care DNA a cerut trimiterea \u00een judecat\u0103, \u00een func\u0163ie de partidul politic din care fac parte. \u00cen acest sens, am f\u0103cut o verificare preliminar\u0103 a <\/span><a href=\"http:\/\/www.pna.ro\/comunicate.xhtml\"><span style=\"font-weight: 400;\">comunicatelor de pres\u0103 ale DNA<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Rezultatele de mai jos se refer\u0103 numai la anul 2017 \u015fi fac trimitere la numele cele mai sonore\/ recognoscibile din list\u0103 (cei a c\u0103ror afiliere politic\u0103 am putut-o afla p\u00e2n\u0103 \u00een acest punct); inten\u021bion\u0103m s\u0103 extindem lista, incluz\u00e2nd comunicate din anii preceden\u0163i.<\/span><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><span style=\"font-weight: 400;\">Am identificat 51 de persoane \u00een comunicatele DNA, unele fiind men\u021bionate \u00een mai mult de un comunicat.
