Am solicitat ca invita\u021bia s\u0103 fie extins\u0103 \u0219i c\u0103tre organiza\u021bia Declic. R\u0103spunsul primit ne-a clarificat natura acestui exerci\u021biu.<\/strong><\/p>\n<p style=\"text-align: center;\"><a class=\"wp-block-button__link has-vivid-red-background-color has-background has-medium-font-size has-custom-font-size wp-element-button\" style=\"border-radius: 60px;\" href=\"https:\/\/funky.ong\/wp-content\/uploads\/2025\/12\/RaspunsFunkyCitizens-ICCJ-2025-1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Cite\u0219te scrisoarea complet\u0103 aici!\u00a0<\/a><\/p>\n<p><span style=\"font-weight: 400;\">\u00cen r\u0103spunsul din 26 noiembrie, conducerea ICCJ ne comunic\u0103 c\u0103 Declic nu a fost invitat deoarece \u201epe rolul instan\u021belor se afl\u0103 un litigiu ini\u021biat de organiza\u021bia amintit\u0103 privind conducerea ICCJ\u201d. Argumentul invocat &#8211; asigurarea \u201eunei abord\u0103ri obiective\u201d \u0219i protejarea \u201ederul\u0103rii procedurilor judiciare\u201d &#8211; dezv\u0103luie tocmai ceea ce pretinde s\u0103 evite: selectarea participan\u021bilor \u00een func\u021bie de gradul lor de critic\u0103 fa\u021b\u0103 de institu\u021bie.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Excluderea unei organiza\u021bii pentru c\u0103 a ales s\u0103 conteste \u00een instan\u021b\u0103 decizii ale conducerii ICCJ nu este neutralitate &#8211; este exact opusul ei.<\/strong> Calea judiciar\u0103 este o form\u0103 legitim\u0103 de participare civic\u0103 \u00eentr-un stat de drept. A exclude pe cineva pentru c\u0103 a exercitat-o echivaleaz\u0103 cu a spune c\u0103 dialogul este rezervat celor care nu deranjeaz\u0103.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mai mult, r\u0103spunsul ICCJ afirm\u0103 c\u0103 au fost invitate \u201eorganiza\u021biile care au relevan\u021b\u0103 \u00een formularea de politici publice, inclusiv care au exprimat puncte de critic\u0103 argumentat\u0103\u201d. Declic a exprimat critic\u0103 argumentat\u0103, prin mijloace legale \u0219i legitime, urm\u0103rind respectarea legii \u0219i nu o procedur\u0103 vexatorie. Acest criteriu implicit &#8211; critic\u0103 da, dar nu <\/span><i><span style=\"font-weight: 400;\">prea mult<\/span><\/i><span style=\"font-weight: 400;\"> &#8211; submineaz\u0103 credibilitatea \u00eentregului exerci\u021biu.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 form\u0103 de r\u0103spuns public vine \u0219i \u00een contextul lipsei garan\u021biilor de transparen\u021b\u0103 demonstrate de conducerea ICCJ \u00een perioada recent\u0103 &#8211; inclusiv discu\u021bii purtate \u00een spatele u\u0219ilor \u00eenchise cu lideri politici, f\u0103r\u0103 transparentizarea ulterioar\u0103 a con\u021binutului acestora. Nu putem valida un dialog a c\u0103rui premis\u0103 este opacitatea.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nu refuz\u0103m s\u0103 particip\u0103m pentru c\u0103 asocia\u021bia Declic nu a fost invitat\u0103. Refuz\u0103m pentru c\u0103 <\/span><i><span style=\"font-weight: 400;\">motivul<\/span><\/i><span style=\"font-weight: 400;\"> pentru care Declic nu a fost invitat\u0103 ne \u00eengrijoreaz\u0103 legat de ce fel de dialog se dore\u0219te: unul controlat, cu participan\u021bi preselecta\u021bi, care s\u0103 produc\u0103 imaginea consult\u0103rii f\u0103r\u0103 substan\u021ba ei.<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400;\">Alegem, \u00een schimb, s\u0103 facem public\u0103 contribu\u021bia noastr\u0103. Ceea ce urmeaz\u0103 nu este un refuz de a discuta, ci o demonstra\u021bie c\u0103 avem ce spune \u0219i c\u0103 prefer\u0103m s\u0103 o spunem \u00een spa\u021biul public, nu \u00eentr-un cadru al c\u0103rui scop pare s\u0103 fie mai degrab\u0103 legitimarea institu\u021biei dec\u00e2t reforma ei.<\/span><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Cu deschidere,<\/span><\/p>\n<p><b>Consiliul Director &#8211; Funky Citizens<\/b><\/p>\n<p>&nbsp;<\/p>\n<hr \/>\n<h2><b>Justi\u021bia \u0219i statul de drept: <\/b><\/h2>\n<h2><b>ce este \u00een joc<\/b><\/h2>\n<p><b>Elefantul din camer\u0103<\/b><\/p>\n<p><span style=\"font-weight: 400;\">S\u0103 \u00eencepem cu ceea ce acest dialog evit\u0103 s\u0103 numeasc\u0103 direct: <strong>pensiile speciale ale magistra\u021bilor<\/strong>. Dezbaterea este declan\u0219at\u0103 de acest subiect, dar el este tratat ca problem\u0103 lateral\u0103, nu central\u0103. Aceasta nu este o \u00eent\u00e2mplare.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Statul de drept pleac\u0103 de la premisa esen\u021bial\u0103 de egalitate \u00een fa\u021ba legii.<\/strong> Discu\u021bia pune sub semnul \u00eentreb\u0103rii tocmai acest principiu. M\u0103surile prezentate ca \u201etemporare\u201d se doresc permanentizate. Pensia trebuie s\u0103 fie contributiv\u0103. Pensia special\u0103 (denumirea deriv\u0103 din derogarea specialului de la regula general\u0103 a contributivit\u0103\u021bii, fiind \u00een mod explicit o preluare a principiului ,,<\/span><i><span style=\"font-weight: 400;\">specialia generalibus derogant<\/span><\/i><span style=\"font-weight: 400;\">\u201d), conceput\u0103 ini\u021bial ca instrument de recrutare \u00een sistem p\u00e2n\u0103 la momentul acord\u0103rii unei salariz\u0103ri corespunz\u0103toare, a devenit un drept c\u00e2\u0219tigat pe care sistemul refuz\u0103 s\u0103 \u00eel renegocieze. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Refuzul oric\u0103rui dialog pe acest subiect este ilegitim, singurul argument valid fiind ad\u0103ugarea \u00een discu\u021bie a salariz\u0103rii \u0219i trecerea la sistemul contributiv, ca solu\u021bie pe termen lung odat\u0103 cu epuizarea etapei de reglare temporar\u0103. Mai mult, aducerea \u00een discu\u021bie a salariz\u0103rii din e\u0219aloanele inferioare ca argument general este o \u00eencercare nereu\u0219it\u0103 prin care se decredibilizeaz\u0103 \u0219i mai mult sistemul de justi\u021bie. Discu\u021bia centrat\u0103 pe propor\u021bionalitatea drepturilor salariale \u00een cadrul profesiilor de magistrat nu poate privi doar argumente izolate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Argumentul invocat frecvent &#8211; incapacitatea judec\u0103torilor de a rezista fizic \u0219i psihic la solicit\u0103rile muncii de magistrat, justific\u00e2nd pensionarea anticipat\u0103 &#8211; nu rezist\u0103 verific\u0103rii practice. <strong>Conform Codului muncii (art. 61 lit. (d)), necorespunderea profesional\u0103 este motiv de \u00eencetare a contractului individual de munc\u0103, nu de pensionare.<\/strong> Mai mult, exemplele practice arat\u0103 c\u0103 magistra\u021bii \u00ee\u0219i continu\u0103 activitatea dup\u0103 pensionare, ca avoca\u021bi, consilieri sau, de regul\u0103, \u00een alte profesii juridice. Nu se retrag din ,,c\u00e2mpul muncii\u201d, ci strict din sistemul public al magistraturii, prin solicitarea intr\u0103rii la pensie. Defini\u021bia legal\u0103 a acestei situa\u021bii este ,,demisie\u201d, nu pensionare.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Solu\u021bia pentru supra\u00eenc\u0103rcare este reducerea volumului de munc\u0103, nu pensia anticipat\u0103 cu beneficii speciale.<\/strong> Dar aceast\u0103 solu\u021bie ar presupune reforme structurale pe care sistemul de justi\u021bie nu le-a cerut niciodat\u0103 cu aceea\u0219i vehemen\u021b\u0103 cu care \u00ee\u0219i ap\u0103r\u0103 privilegiile.\u00a0<\/span><\/p>\n<p><b>Aici este problema fundamental\u0103: marea majoritate a magistra\u021bilor pare s\u0103 se mobilizeze pentru propriile interese, dar nu \u0219i pentru reformele sistemice care ar servi cet\u0103\u021beanul. <\/b><span style=\"font-weight: 400;\">Nu am v\u0103zut niciodat\u0103 o mobilizare comparabil\u0103 pentru digitalizare, pentru reducerea duratei proceselor, pentru accesul efectiv la justi\u021bie. Aceast\u0103 asimetrie submineaz\u0103 credibilitatea oric\u0103rei declara\u021bii de deschidere la dialog. Ba chiar putem spune c\u0103 digitalizarea care a func\u021bionat \u00een perioada pandemiei COVID nu a avut nevoie de o modificare structural\u0103 a infrastructurii, lucrurile se puteau face \u0219i mai devreme, dac\u0103 sistemul de justi\u021bie reprezentat de ICCJ ar fi dorit asta.<\/span><\/p>\n<p><b>Justi\u021bia ca putere \u00een stat vs. justi\u021bia ca serviciu public<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Invita\u021bia ICCJ vorbe\u0219te despre \u201eserviciul public de justi\u021bie\u201d. Este o formulare revelatoare. Exist\u0103 o tensiune nerezolvat\u0103 \u00een modul \u00een care sistemul se raporteaz\u0103 la propria identitate: este justi\u021bia o putere \u00een stat sau un serviciu public?<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Constitu\u021bia define\u0219te clar: <strong>justi\u021bia este una dintre cele trei puteri ale statului.<\/strong> Dar aceast\u0103 putere nu rezid\u0103 indivizibil \u00een fiecare judec\u0103tor &#8211; ea se manifest\u0103 institu\u021bional, prin hot\u0103r\u00e2ri definitive, prin practic\u0103 unitar\u0103, prin predictibilitate. Fiecare judec\u0103tor particip\u0103 la \u00eenf\u0103ptuirea justi\u021biei, dar nu este de\u021bin\u0103torul ei \u00een nume propriu.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Confuzia \u00eentre cele dou\u0103 \u00een\u021belesuri permite un joc retoric convenabil: c\u00e2nd se cer drepturi \u0219i privilegii, magistratul invoc\u0103 demnitatea puterii judec\u0103tore\u0219ti; c\u00e2nd se cer reforme \u0219i transparen\u021b\u0103, sistemul se refugiaz\u0103 \u00een tehnicitatea serviciului public. Aceast\u0103 ambiguitate cultivat\u0103 nu serve\u0219te nici justi\u021bia, nici cet\u0103\u021beanul \u0219i, de dat\u0103 recent\u0103, nici magistra\u021bilor.<\/span><\/p>\n<p><b>Independen\u021ba justi\u021biei: mai mult dec\u00e2t bani<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Discursul dominant reduce independen\u021ba justi\u021biei la dimensiunea financiar\u0103: salarii mari, pensii speciale, bugete consistente. Dar nu exist\u0103 un \u201eplafon de incoruptibilitate\u201d &#8211; niciun nivel salarial nu garanteaz\u0103, \u00een sine, independen\u021ba. Garan\u021biile reale ale independen\u021bei sunt altele: transparen\u021ba proceselor de numire \u0219i promovare; absen\u021ba ,,c\u00e2mpurilor tactice\u201d prin care se influen\u021beaz\u0103 inclusiv repartizarea dosarelor; lipsa presiunilor interne, de la colegi sau conducere; asumarea public\u0103 a deciziilor \u0219i motiv\u0103rilor.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Independen\u021ba \u00een \u00eenf\u0103ptuirea justi\u021biei \u00eenseamn\u0103 independen\u021b\u0103 fa\u021b\u0103 de <\/span><i><span style=\"font-weight: 400;\">orice <\/span><\/i><span style=\"font-weight: 400;\">ingerin\u021be &#8211; inclusiv din interiorul sistemului. R\u0103zboaiele \u00eentre magistra\u021bi, frac\u021biunile din CSM (Consiliul Superior al Magistraturii), tensiunile dintre instan\u021be \u0219i parchete nu sunt expresia independen\u021bei, ci simptome ale unei guvernan\u021be interne defectuoase.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Un exemplu recent:<\/strong> activitatea judec\u0103torilor ICCJ \u00een cadrul Biroului Electoral Central s-a desf\u0103\u0219urat netransparent, cu decizii contestate (inclusiv privind observarea procesului de votare prin intermediul urnelor speciale), care au afectat \u00eencrederea \u00een procesul electoral. Chiar dac\u0103 BEC este un organism distinct, componen\u021ba sa \u0219i modul de operare se r\u0103sfr\u00e2ng \u0219i asupra imaginii instan\u021bei supreme. Independen\u021ba nu poate fi invocat\u0103 selectiv.\u00a0<\/span><\/p>\n<p><b>Prescrip\u021bia \u0219i protejarea interesului public<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Decizia CCR (Curtea Constitu\u021bional\u0103 a Rom\u00e2niei) privind prescrip\u021bia a creat o situa\u021bie \u00een care dosare importante de corup\u021bie \u0219i crim\u0103 organizat\u0103 s-au prescris sau risc\u0103 s\u0103 se prescrie. Exist\u0103 un dezechilibru evident \u00eentre protejarea intereselor generale ale societ\u0103\u021bii \u0219i modul actual de instrumentare a acestor dosare.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rolul justi\u021biei \u00een statul de drept nu presupune introducerea, <\/span><i><span style=\"font-weight: 400;\">de facto<\/span><\/i><span style=\"font-weight: 400;\">, a unei noi etape procesuale &#8211; prescrip\u021bia ca modalitate de solu\u021bionare. Este adev\u0103rat c\u0103 declararea neconstitu\u021bionalitat\u0103\u021bii prevederilor anterioare a creat o problem\u0103. Dar termenul r\u0103mas pentru solu\u021bionarea cauzelor era unul rezonabil. Sistemul nu a tratat aceast\u0103 urgen\u021b\u0103 ca pe o prioritate, ci ca pe un mod de a evita pronun\u021barea solu\u021biilor, av\u00e2nd o scuz\u0103 convenabil\u0103. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Este \u00eens\u0103 evident c\u0103 de\u0219i aceste dosare sunt mai vizibile, prescrip\u021bia a intervenit \u0219i \u00een mari dosare de crim\u0103 organizat\u0103, trafic de persoane, evaziune fiscal\u0103 major\u0103. <strong>Fiecare dosar prescris este un mesaj: sistemul nu a reu\u0219it s\u0103 fac\u0103 dreptate \u00een timp util.<\/strong> Acest e\u0219ec este sistemic, nu accidental.\u00a0<\/span><\/p>\n<p><b>Limitele acestei dezbateri<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Problemele justi\u021biei, ca \u0219i cele ale societ\u0103\u021bii cu justi\u021bia, nu \u021bin doar de activitatea din sala de judecat\u0103. Inclusiv aceast\u0103 dezbatere are limitarea de a cuprinde doar par\u021bial ni\u0219te probleme altfel sistemice, complexe, pe care ICCJ nu are nici atribu\u021biile \u0219i nici capacitatea de a le rezolva singur\u0103. De altfel, majoritatea problemelor cu care se confrunt\u0103 justi\u021bia depind de conlucrare \u00eentre institu\u021biile publice \u0219i societate, sub acest aspect demersul dvs. fiind unul necesar, dar nu \u0219i suficient.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Cre\u0219terea rolului proactiv al justi\u021biei se impune, chiar dac\u0103 aparent este contraintuitiv.\u00a0 Deprinderea cu principiul disponibilit\u0103\u021bii poate fi un defect profesional, dar aceast\u0103 disponibilitate \u021bine de procedura din sala de judecat\u0103, nu de sistemul de justi\u021bie \u00een sine, acesta neput\u00e2nd fi doar reactiv.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rolul CSM, formarea magistra\u021bilor la INM (Institutul Na\u021bional al Magistraturii), rela\u021bia dintre instan\u021be \u0219i parchete, digitalizarea fragmentat\u0103, statutul personalului auxiliar, sediile instan\u021belor &#8211; toate acestea dep\u0103\u0219esc competen\u021bele Cur\u021bii Supreme. Dar tocmai de aceea <strong>un dialog autentic ar fi trebuit s\u0103 includ\u0103 to\u021bi actorii relevan\u021bi, nu s\u0103 ri\u0219te s\u0103 devin\u0103 un exerci\u021biu de imagine al unei singure institu\u021bii.\u00a0<\/strong><\/span><\/p>\n<h2><b>Identificarea nevoilor \u0219i disfunc\u021biilor percepute la nivelul societ\u0103\u021bii<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Invita\u021bia ICCJ vorbe\u0219te despre disfunc\u021bii percepute. Formularea sugereaz\u0103 c\u0103 problemele ar fi, cel pu\u021bin par\u021bial, o chestiune de imagine public\u0103. Nu sunt. Ele exist\u0103 \u00een sistem, sunt documentate \u0219i au consecin\u021be reale.\u00a0<\/span><\/p>\n<p><b>Recrutarea, selec\u021bia \u0219i promovarea magistra\u021bilor<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Sistemul actual de recrutare prin INM nu d\u0103 rezultate satisf\u0103c\u0103toare. Tineri absolven\u021bi, f\u0103r\u0103 experien\u021b\u0103 practic\u0103, sunt arunca\u021bi direct \u00een complete de judecat\u0103 la nivel de judec\u0103torie &#8211; acolo unde volumul este cel mai mare \u0219i diversitatea cauzelor cea mai ampl\u0103.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Critica frecvent\u0103, venit\u0103 dinspre justi\u021biabili, privind \u201ev\u00e2rsta fraged\u0103\u201d a judec\u0103torilor nu este despre v\u00e2rst\u0103 \u00een sine, ci despre absen\u021ba unei curbe de \u00eenv\u0103\u021bare programate. <strong>Nu exist\u0103 un sistem de mentorat real, de specializare progresiv\u0103, de protec\u021bie a tinerilor magistra\u021bi fa\u021b\u0103 de epuizare.<\/strong> Sistemul \u00eei supune din start solicit\u0103rilor maxime, sub mormane de dosare, pentru c\u0103 cei cu experien\u021b\u0103 au avansat spre instan\u021be superioare cu volume mai mici.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aceast\u0103 structur\u0103 nu este accidental\u0103. Ea se reproduce \u00een multe organiza\u021bii \u00een care conducerile sunt con\u0219tiente de propriile limit\u0103ri care ar deveni vizibile \u00een cazul promov\u0103rii reale pe baz\u0103 de competen\u021b\u0103. Nu credem c\u0103 este cazul justi\u021biei, drept pentru care aceasta nu are de ce s\u0103 preia sisteme necorespunz\u0103toare, ale c\u0103ror rezultate nefaste le putem constata.<\/span><\/p>\n<p><b>Predictibilitatea \u0219i unificarea practicii<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Cet\u0103\u021beanul \u0219i avocatul care intr\u0103 \u00eentr-o sal\u0103 de judecat\u0103 ar trebui s\u0103 poat\u0103 anticipa, \u00een limite rezonabile, cum va fi interpretat\u0103 legea. Aceast\u0103 predictibilitate este esen\u021ba statului de drept aplicat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cen realitate, practica r\u0103m\u00e2ne fragmentat\u0103. Recursurile \u00een interesul legii \u0219i hot\u0103r\u00e2rile prealabile unific\u0103 formal, dar implementarea este inegal\u0103. Motiv\u0103rile r\u0103m\u00e2n, adesea, formule standard care nu explic\u0103 ra\u021bionamentul real. Un cet\u0103\u021bean care pierde un proces nu \u00een\u021belege de ce \u2013 \u0219i nici nu are cum s\u0103 \u00een\u021beleag\u0103, c\u00e2nd motivarea este o \u00een\u0219iruire de texte legale f\u0103r\u0103 analiz\u0103 real\u0103 a spe\u021bei. <strong>Cunosc\u00e2nd limit\u0103rile de \u00een\u021belegere pentru neprofesioni\u0219ti a unui limbaj aparent curent, subliniem c\u0103 \u00een cazurile acestea nici profesioni\u0219ti ai dreptului nu pot descifra un silogism care lipse\u0219te.<\/strong><\/span><\/p>\n<p><b>Digitalizarea: \u00eentre declara\u021bii \u0219i realitate<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Digitalizarea justi\u021biei r\u0103m\u00e2ne fragmentat\u0103 \u0219i inconsistent\u0103. <strong>Sistemele nu comunic\u0103 \u00eentre ele, procedurile variaz\u0103 de la o instan\u021b\u0103 la alta, accesul electronic la dosare este par\u021bial \u0219i imprevizibil.<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Aparent paradoxal, instan\u021bele care au implementat cele mai deschise proceduri digitale demonstreaz\u0103 c\u0103 este posibil. Dar aceste exemple r\u0103m\u00e2n izolate, dependente de ini\u021biativa regional\u0103 de la nivelul Cur\u021bii de Apel, ne\u00eencorporate \u00eentr-o strategie unitar\u0103. Lipsa de coordonare nu este o fatalitate \u2013 este o alegere.
