Po\u021bi semna scrisoarea <a href=\"https:\/\/bit.ly\/4313l89\" target=\"_blank\" rel=\"noopener\">here<\/a>.<\/span><\/strong><\/p>\n<p style=\"text-align: center;\"><a class=\"wp-block-button__link has-vivid-red-background-color has-background has-medium-font-size has-custom-font-size wp-element-button\" href=\"https:\/\/funky.ong\/wp-content\/uploads\/2026\/05\/Scrisoare-deschisa_-Libertatea-de-asociere-nu-poate-fi-restransa-sub-pretextul-transparentei.docx.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Semnatarii scrisorii <em>(update: 18 mai, ora 17:00)<\/em><\/a><\/p>\n<p><span style=\"font-weight: 400;\">\u201eDoamnelor \u0219i domnilor care ne reprezenta\u021bi \u00een Parlamentul Rom\u00e2niei,<\/span><\/p>\n<p><span style=\"font-weight: 400;\">V\u0103 transmitem \u00eengrijorarea noastr\u0103 profund\u0103 cu privire la <\/span><a href=\"https:\/\/www.senat.ro\/legis\/lista.aspx?nr_cls=L233&amp;an_cls=2026\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ini\u021biativa legislativ\u0103<\/span><\/a><span style=\"font-weight: 400;\"> pentru completarea<strong> Ordonan\u021bei Guvernului nr.26\/2000<\/strong> cu privire la asocia\u021bii \u0219i funda\u021bii care va fi dezb\u0103tut\u0103 ast\u0103zi \u00een plenul Senatului Rom\u00e2niei \u0219i ulterior \u00een Camera Deputa\u021bilor, \u00een calitatea sa de Camer\u0103 decizional\u0103.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Instituirea unei obliga\u021bii generale de publicare a identit\u0103\u021bii donatorilor unei asocia\u021bii \u0219i funda\u021bii \u00een condi\u021biile \u00een care institu\u021biile statului rom\u00e2n de\u021bin aceste informa\u021bii \u0219i au toate instrumentele legale de a ac\u021biona atunci c\u00e2nd identific\u0103 o situa\u021bie de nelegalitate,<\/strong> c\u0103reia i se al\u0103tur\u0103 sanc\u021biuni excesiv de drastice, respectiv suspendarea activit\u0103\u021bii pentru simpla nedepunere a acestei declara\u021bii, urmat\u0103 de dizolvarea de drept <strong>sunt m\u0103suri dispropor\u021bionate care transform\u0103 organiza\u021biile private \u00eentr-un obiect al suspiciunii publice permanente \u0219i le pot pune \u00een imposibilitatea de a func\u021biona.<\/strong><\/span><\/p>\n<p><span style=\"font-weight: 400;\">Sunte\u021bi \u00een pozi\u021bia de a opri rapid un demers care este \u00eenceputul unui proces de restr\u00e2ngere accelerat\u0103 a spa\u021biului civic din Rom\u00e2nia, care se aseam\u0103n\u0103 cu tiparul folosit \u00een Rusia \u0219i, ulterior, \u00een alte c\u00e2teva state sanc\u021bionate ferm de instan\u021be judec\u0103tore\u0219ti \u0219i institu\u021bii din Uniunea European\u0103 \u0219i Consiliul Europei.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\"><strong>Textul propus ridic\u0103 probleme serioase de constitu\u021bionalitate, compatibilitate cu standardele europene privind dreptul la libera asociere, dreptul la via\u021b\u0103 privat\u0103 \u0219i \u00eenc\u0103lc\u0103ri ale standardelor de calitate a legii.<\/strong> Conform art. 53 din Constitu\u021bia Rom\u00e2niei, exerci\u0163iul unor drepturi sau al unor libert\u0103\u0163i fundamentale poate fi restr\u00e2ns numai \u00een anumite cazuri limitativ prev\u0103zute de Constitu\u021bie. Chiar \u0219i a\u0219a, restr\u00e2ngerea poate fi dispus\u0103 numai dac\u0103 urm\u0103re\u0219te un scop legitim, este necesar\u0103 \u00eentr-o societate democratic\u0103, iar m\u0103sura trebuie s\u0103 fie propor\u0163ional\u0103 cu situa\u0163ia care a determinat-o, s\u0103 fie aplicat\u0103 \u00een mod nediscriminatoriu \u015fi f\u0103r\u0103 a aduce atingere existen\u0163ei dreptului sau a libert\u0103\u0163ii.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Ad\u0103ug\u0103m argumentele noastre celor deja aduse \u00een avizele negative ale <a href=\"https:\/\/www.senat.ro\/legis\/PDF\/2026\/26L233ES.PDF?nocache=true\" target=\"_blank\" rel=\"noopener\">Consiliului Economic \u0219i Social<\/a><\/span><span style=\"font-weight: 400;\">, <a href=\"https:\/\/www.senat.ro\/legis\/PDF\/2026\/26L233LG.PDF?nocache=true\" target=\"_blank\" rel=\"noopener\">Consiliului Legislativ<\/a><\/span><span style=\"font-weight: 400;\"> and <a href=\"https:\/\/www.senat.ro\/legis\/PDF\/2026\/26L233CA45.PDF?nocache=true\" target=\"_blank\" rel=\"noopener\">Comisiei pentru drepturile omului, egalitate de \u0219anse, culte \u0219i minorit\u0103\u021bi din Senatul Rom\u00e2niei<\/a><\/span><span style=\"font-weight: 400;\">. Argumentele care stau la baza solicit\u0103rii noastre sunt prezentate \u00een anexa de mai jos \u0219i demonstreaz\u0103 c\u0103 ini\u021biativa legislativ\u0103 nu este oportun\u0103.<\/span><\/p>\n<blockquote><p><b>V\u0103 solicit\u0103m s\u0103 ac\u021biona\u021bi \u00een spiritul standardelor interna\u021bionale la care Rom\u00e2nia a aderat prin decizia sa suveran\u0103 de a fi membr\u0103 at\u00e2t a Uniunii Europene, c\u00e2t \u0219i a Consiliului Europei \u0219i s\u0103 finaliza\u021bi procesul legislativ pentru aceast\u0103 ini\u021biativ\u0103 fie prin respingerea ei cu celeritate, fie prin retragerea ei de c\u0103tre ini\u021biatori.\u00a0<\/b><\/p><\/blockquote>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">\u00cencuraj\u0103m autorit\u0103\u021bile \u0219i institu\u021biile publice din Rom\u00e2nia care colecteaz\u0103 date cu privire la activitatea organiza\u021biilor neguvernamentale s\u0103 comunice cum proceseaz\u0103 aceste date, dac\u0103 \u0219i cum sunt folosite \u00een scopul pentru care au fost colectate \u0219i s\u0103 fac\u0103 demersurile legale pe care le au \u00een competen\u021b\u0103 pentru a furniza celor care au drept de ini\u021biativ\u0103 legislativ\u0103 \u0219i publicului datele necesare care s\u0103 fundamenteze eventualele reglement\u0103ri viitoare. Elaborarea oric\u0103rui act normativ trebuie s\u0103 aib\u0103 un scop legitim care s\u0103 fie ancorat \u00eentr-o realitate bazat\u0103 pe date concrete, astfel \u00eenc\u00e2t societatea s\u0103 aib\u0103 \u00eencredere \u00een actul de legiferare, care s\u0103 elimine costurile inutile.<\/span><\/p>\n<hr \/>\n<p><b>Anexa<\/b><\/p>\n<p><em><span style=\"font-weight: 400;\">Elemente de context \u0219i argumente \u00een sprijinul solicit\u0103rilor noastre:<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Reamintim c\u0103, \u00een Rom\u00e2nia, cadrul normativ \u0219i de raportare con\u021bine deja toate instrumentele de colectare de informa\u021bii care pot fi considerate, dup\u0103 caz, de interes public, iar autorit\u0103\u021bile competente rom\u00e2ne primesc aceste informa\u021bii de la sectorul privat \u0219i pot aplica sanc\u021biuni \u00een cazul \u00een care acest lucru nu se \u00eent\u00e2mpl\u0103. Ini\u021biativa legislativ\u0103 ignor\u0103 complet c\u0103 <\/span><b>statul roman poate identifica cu precizie cine sunt donatorii \u0219i sponsorii unui ONG<\/b><span style=\"font-weight: 400;\"> prin \u00eencruci\u0219area raport\u0103rilor contabile, fiscale \u0219i bancare deja existente \u00een sistemul ANAF:<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Astfel, cu excep\u021bia unit\u0103\u021bilor de cult \u0219i a asocia\u021biilor de proprietari, toate asocia\u021biile, funda\u021biile \u0219i federa\u021biile \u00eenfiin\u021bate \u00een baza OG 26\/2000 trebuie s\u0103 \u021bin\u0103 contabilitatea \u00een sistem de partid\u0103 dubl\u0103<\/span><span style=\"font-weight: 400;\">. Mai jos, c\u00e2teva din raport\u0103rile obligatorii pentru ONGuri \u0219i modalit\u0103\u021bile prin care statul roman poate deja s\u0103 identifice donatorii acestora:<\/span><\/em><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Anual: bilan\u021b contabil, contul rezultatului exerci\u021biului financiar pentru anul anterior, note explicative aferente. \u00cencep\u00e2nd cu exerci\u021biul financiar aferent anului 2023, a fost introdus\u0103 \u0219i obliga\u021bia depunerii unei declara\u021bii de trezorerie pentru ONG-uri care, \u00een cursul exerci\u021biului financiar, au primit sume reprezent\u00e2nd subven\u021bii, sponsoriz\u0103ri, sume redirec\u021bionate din impozite (ex. 3,5% din impozitul pe venit, redirec\u021bion\u0103ri din impozitul pe profit\/micro\u00eentreprinderi) sau alte forme similare.<\/span><span style=\"font-weight: 400;\"> Declara\u021bia con\u021bine informa\u021bii despre \u00eencas\u0103rile men\u021bionate mai sus \u0219i modul \u00een care au fost utilizate aceste sume (pl\u0103\u021bi de salarii, achizi\u021bii, chirii etc.).\u00a0\u00a0<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Din 2025, asocia\u021biile \u0219i funda\u021biile sunt obligate s\u0103 depun\u0103 declara\u021bii \u00een cadrul sistemului SAF-T care asigur\u0103 accesul institu\u021biilor statului rom\u00e2n la un nivel extrem de detaliat de informa\u021bii privind tranzac\u021biile organiza\u021biei \u0219i permite identificarea p\u0103r\u021bilor tranzac\u021biilor.\u00a0 Prin intermediul acestei declara\u021bii, ANAF prime\u0219te acces direct, \u00een format electronic structurat, la baza de date contabil\u0103 a organiza\u021biei. Orice donator al c\u0103rui nume \u0219i cod de identificare fiscal\u0103\/CNP au fost introdu\u0219i \u00een softul de contabilitate pentru \u00eenregistrarea notelor contabile devine automat vizibil \u0219i identificabil pentru stat.<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Ca s\u0103 poat\u0103 primi o sponsorizare, un ONG trebuie s\u0103 fie \u00eenscris \u00een Registrul entit\u0103\u021bilor\/unit\u0103\u021bilor de cult pentru care se acord\u0103 deduceri fiscale. Atunci c\u00e2nd o companie sponsorizeaz\u0103 un ONG \u0219i dore\u0219te s\u0103 \u00ee\u0219i deduc\u0103 acea sum\u0103 din impozit, ea este obligat\u0103 prin lege s\u0103 depun\u0103 o raportare specific\u0103 care include denumirea \u0219i codul de identificare fiscal\u0103 al ONG-ului.<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Pentru sumele redirec\u021bionate prin sistemul 3,5%, statul de\u021bine controlul direct asupra sursei: statul este cel care proceseaz\u0103 formularele, vede CNP-ul persoanei \u0219i vireaz\u0103 banii din trezorerie \u00een contul ONG-ului. Statul controleaz\u0103 integral aceast\u0103 identitate.<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">\u00cen cazul dona\u021biilor de la persoane fizice: pentru sume care dep\u0103\u0219esc 25.000 de lei, Codul civil din Rom\u00e2nia oblig\u0103 p\u0103r\u021bile s\u0103 \u00eencheie un contract de dona\u021bie \u00een form\u0103 autentic\u0103 (la notar). \u00cen acest contract sunt trecute obligatoriu datele de identitate complete (nume, CNP, domiciliu). Notarii raporteaz\u0103 periodic c\u0103tre stat actele autentificate. Pentru sumele sub 25.000 de lei: dac\u0103 sunt donate prin virament bancar, se \u00eenregistreaz\u0103 obligatoriu identitatea donatorului; dac\u0103 dona\u021bia este \u00een numerar, este obligatorie emiterea unei chitan\u021be sau a unui ordin de \u00eencasare care include datele de identificare ale pl\u0103titorului, iar aceasta este \u00eenregistrat\u0103 \u00een contabilitatea ONG-ului la care statul rom\u00e2n are acces. Dac\u0103 ONG-ul prime\u0219te bani cash \u0219i nu \u00eei \u00eenregistreaz\u0103 \u00een contabilitate (nu taie chitan\u021b\u0103 sau bon), fapta constituie contraven\u021bie sau infrac\u021biune (evaziune fiscal\u0103). \u00cen cadrul unui control, inspectorii ANAF verific\u0103 corela\u021bia dintre stocul fizic de bani din seif \u0219i soldul scriptic din Registrul de Cas\u0103. Orice plus sau minus nejustificat aduce amenzi severe \u0219i confiscarea sumelor.<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">Prin intermediul reglement\u0103rilor bancare \u0219i a celor care se refer\u0103 la combaterea sp\u0103l\u0103rii banilor \u0219i prevenirii finan\u021b\u0103rii terorismului<\/span><span style=\"font-weight: 400;\">: ANAF are acces \u00een Registrul Centralizator al Conturilor Bancare unde apar denumirile persoanelor juridice, respectiv numele persoanelor fizice care au efectuat viramente c\u0103tre or organiza\u021bie neguvernamental\u0103. Conform legii pentru prevenirea \u0219i combaterea sp\u0103l\u0103rii banilor, b\u0103ncile raporteaz\u0103 automat c\u0103tre Oficiul Na\u021bional de Prevenire \u0219i Combatere a Sp\u0103l\u0103rii Banilor (ONPCSB) tranzac\u021biile suspecte sau cele care dep\u0103\u0219esc plafoanele legale, unde identitatea donatorului este obligatoriu verificat\u0103.<\/span><\/em><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><em><span style=\"font-weight: 400;\">\u00cen cazul transferurilor transfrontaliere: orice transfer bancar extern ini\u021biat de un donator str\u0103in c\u0103tre contul de lei sau valut\u0103 al unui ONG din Rom\u00e2nia con\u021bine obligatoriu numele donatorului, codul IBAN\/num\u0103rul de cont \u0219i banca de origine. B\u0103ncile comerciale din Rom\u00e2nia au obliga\u021bia legal\u0103 de a monitoriza \u0219i de a raporta c\u0103tre Oficiul Na\u021bional de Prevenire \u0219i Combatere a Sp\u0103l\u0103rii Banilor (ONPCSB) tranzac\u021biile externe care dep\u0103\u0219esc plafoanele legale. \u00cen aceste raport\u0103ri, identitatea complet\u0103 a donatorului este transmis\u0103 statului.<\/span><\/em><\/li>\n<\/ul>\n<p><em><span style=\"font-weight: 400;\">\u00cen circuitele financiare legale din Rom\u00e2nia, autorit\u0103\u021bile fiscale \u0219i bancare au deja posibilitatea de a reconstitui identitatea donatorilor prin mecanismele contabile, fiscale \u0219i bancare existente. Pseudoanonimatul pe care un donator \u00eel poate alege este valabil exclusiv \u00een raport cu publicul larg sau cu afi\u0219area pe site-ul asocia\u021biei, \u00eens\u0103 autorit\u0103\u021bile fiscale \u0219i bancare pot identifica persoana prin verificarea documentelor contabile sau a traseului banilor.<\/span><\/em><\/p>\n<p><i>Mai mult, prelucrarea suplimentar\u0103 a datelor personale devine astfel o obliga\u021bie excesiv\u0103, ce \u00eencalc\u0103 principiile prelucr\u0103rii datelor cu caracter personal, conform art. 5 din Regulamentul UE 679\/2016 (GDPR).<\/i><\/p>\n<p><em><span style=\"font-weight: 400;\">Sanc\u021biunea\u201esuspend\u0103rii de drept a activit\u0103\u021bii\u201d este o sintagm\u0103 foarte vag\u0103, contrar\u0103 principiilor de calitate \u0219i precizie a legii \u0219i e o restr\u00e2ngere sever\u0103\u00a0 a dreptului de asociere. Ini\u021biativa legislativ\u0103 introduce o sanc\u021biune juridic nedefinit\u0103, mai sever\u0103 dec\u00e2t multe sanc\u021biuni administrative sau penale existente.<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Sintagma \u201esuspendarea de drept a activit\u0103\u021bii persoanei juridice\u201d nu este definit\u0103 de legisla\u021bia rom\u00e2n\u0103 \u0219i nu exist\u0103 ca institu\u021bie juridic\u0103 general\u0103 \u00een materia ONG-urilor. OG 26\/2000 nu reglementeaz\u0103 suspendarea activit\u0103\u021bii asocia\u021biilor \u0219i funda\u021biilor, iar dreptul rom\u00e2n nu cunoa\u0219te o suspendare automat\u0103 \u0219i general\u0103 a activit\u0103\u021bii unei persoane juridice private.<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Sanc\u021biunea este incompatibil\u0103 cu principiul propor\u021bionalit\u0103\u021bii sanc\u021biunilor \u0219i este mai sever\u0103 dec\u00e2t regimurile existente \u00een dreptul penal sau contraven\u021bional. Suspendarea activit\u0103\u021bii unei persoane juridice este o pedeaps\u0103 complementar\u0103 prev\u0103zut\u0103 de Codul penal la art. 140, cu alte cuvinte, este stabilit\u0103 r\u0103spunderea penal\u0103 a persoanei juridice. P\u00e2n\u0103 \u0219i acolo, judec\u0103torul este cel care decide dac\u0103 aplic\u0103 pedeapsa complementar\u0103 a suspend\u0103rii, adic\u0103 \u201einterzicerea desf\u0103\u0219ur\u0103rii activit\u0103\u021bii sau a uneia dintre activit\u0103\u021bile persoanei juridice \u00een realizarea c\u0103reia a fost s\u0103v\u00e2r\u0219it\u0103 infrac\u021biunea\u201d. \u00cen amendamentul propus, se suspend\u0103 automat (\u201ede drept\u201d) toat\u0103 activitatea unui ONG, indiferent de raporturile juridice pe care le are \u00een derulare (raporturi comerciale, de munc\u0103, de voluntariat etc.).<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Mai mult, m\u0103sura suspend\u0103rii de drept propus\u0103 este mai strict\u0103 dec\u00e2t m\u0103surile din materia contraven\u021bional\u0103 \u00een domeniul protec\u021biei consumatorilor, de exemplu. \u00cen OG 21\/1992 privind protec\u021bia consumatorilor, sanc\u021biunea complementar\u0103 de la art. 56 este &#8222;suspendarea sau retragerea definitiv\u0103, dup\u0103 caz, a avizului, acordului sau a autoriza\u021biei de exercitare a unei activit\u0103\u021bi\u201d, adic\u0103 se men\u021bioneaz\u0103 exact actul administrativ vizat, nu \u201eactivitatea\u201d.\u00a0 \u00a0\u00a0<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">\u00centr-un stat democratic, transparen\u021ba trebuie s\u0103 urm\u0103reasc\u0103 asigurarea responsabilit\u0103\u021bii \u00een exercitarea puterii publice, nu transformarea organiza\u021biilor private \u00eentr-un obiect al suspiciunii publice permanente. Ini\u021biativa legislativ\u0103 nu trece testul de necesitate \u0219i propor\u021bionalitate \u00een raport cu art. 11 din Conven\u021bia European\u0103 a Drepturilor Omului \u0219i art. 12 din Carta drepturilor fundamentale a Uniunii Europene.<\/span><\/em><\/p>\n<p><em><span style=\"font-weight: 400;\">Standardele europene disting \u00een mod constant \u00eentre obliga\u021biile legitime de raportare c\u0103tre autorit\u0103\u021bile publice \u0219i mecanismele de expunere public\u0103 dispropor\u021bionat\u0103 a organiza\u021biilor \u0219i a sus\u021bin\u0103torilor lor.
