Funky Citizens a fost prezent prin intermediul avocatei Simona Calapodescu \u0219i a venit cu observa\u021bii concrete privind reforma legisla\u021biei electorale. Modificarea legisla\u021biei electorale <\/b><b><\/b><\/h2>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">\u00cen urma ciclului electoral 2024\u20132025, putem formula o serie de recomand\u0103ri privind reforma legisla\u021biei electorale. <strong>Principalele propuneri vizeaz\u0103 stabilitatea \u0219i predictibilitatea cadrului normativ, transparen\u021ba procesului electoral, profesionalizarea administra\u021biei electorale \u0219i consolidarea drepturilor aleg\u0103torilor \u0219i observatorilor independen\u021bi.<\/strong><\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Recomand\u0103m, \u00een primul r\u00e2nd, <strong>evitarea modific\u0103rilor ad-hoc prin ordonan\u021be de urgen\u021b\u0103 \u0219i adoptarea unui cadru legislativ unitar \u0219i predictibil,<\/strong> inclusiv prin elaborarea unui Cod Electoral coerent. A\u0219a cum am sus\u021binut \u0219i \u00een discu\u021bia din 21.05.2026, sus\u021binem unificarea reglement\u0103rilor prin aprobarea unor hot\u0103r\u00e2ri stabile, unitare, \u00een detrimentul celor emise cu ocazia fiec\u0103rui tur de scrutin, pentru aspecte de competen\u021ba AEP (ex. procedura solicit\u0103rii urnei mobile, accesibilitate sec\u021bii, standardizarea materialelor electorale, securitatea sec\u021biilor de votare etc.). Mai mult, insist\u0103m pentru \u00eembun\u0103t\u0103\u021birea at\u00e2t a condi\u021biilor de lucru pentru birourile sec\u021biei de votare (ex. reconfigurarea sec\u021biilor cu un istoric \u00eendelungat de supraaglomerare, spa\u021bii inadecvate din punct de vedere al dimensiunii, dot\u0103rii, accesibilit\u0103\u021bii etc.), c\u00e2t \u0219i a materialelor de vot (ex. redefinirea sigiliilor, standardizarea materialelor de vot etc.).<\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">\u00cen ceea ce prive\u0219te administra\u021bia electoral\u0103, <strong>recomand\u0103m reducerea influen\u021bei politice asupra birourilor electorale \u0219i profesionalizarea corpului exper\u021bilor electorali prin recrutare, evaluare transparent\u0103 \u0219i formare continu\u0103.<\/strong> Factorul de motivare pecuniar\u0103 nu trebuie ignorat, \u00een simetrie cu sanc\u021biunea excluderii \u00een cazul neparticip\u0103rii la formare, respectiv \u00een cazul constat\u0103rii lipsei de preg\u0103tire a exper\u021bilor electorali. De asemenea, este recomandat\u0103 elaborarea unor ghiduri clare privind desf\u0103\u0219urarea procesului electoral \u0219i instruirea riguroas\u0103 a membrilor birourilor electorale \u0219i a for\u021belor de ordine \u00een domeniul legisla\u021biei electorale. Ghidurile ar trebui s\u0103 respecte legisla\u021bia electoral\u0103, \u00een trecut confrunt\u00e2ndu-ne cu introducerea \u00een ghiduri a unor elemente nelegale, de interpretare gre\u0219it\u0103 sau restrictiv\u0103 a legii, contrare spiritului legii privind transparen\u021ba \u0219i corectitudinea procesului electoral (ex. restric\u021bionarea accesului observatorilor la procedura renum\u0103r\u0103rii, a votului prin urna mobil\u0103, un pretins vid legislativ referitor la \u00eendep\u0103rtarea materialelor de propagand\u0103 electoral\u0103 din ziua votului etc.).<\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Formarea electoral\u0103 presupune \u0219i <strong>preg\u0103tirea agen\u021bilor de poli\u021bie \u0219i jandarmerie \u00een paralel cu personalul sec\u021biilor de votare,<\/strong> cu clarificarea atribu\u021biilor lor \u0219i a situa\u021biilor \u201egri\u201d (de exemplu, competen\u021ba pre\u0219edin\u021bilor \u00een jurul sec\u021biei de votare, \u00een raport cu men\u021binerea ordinii \u0219i controlul propagandei electorale). Insist\u0103m totodat\u0103 \u0219i asupra unei <strong>coordon\u0103ri cu Ministerul Afacerilor Externe \u0219i autorit\u0103\u021bile statelor str\u0103ine \u00een vederea asigur\u0103rii unei reale siguran\u021be a personalului electoral al sec\u021biilor de votare din str\u0103in\u0103tate<\/strong>, \u00een contextul unor incidente violente din ultimii ani sau al \u201esimplei\u201d imposibilit\u0103\u021bi de a aplica legea rom\u00e2n\u0103. Imaginile cu violen\u021b\u0103 la adresa aleg\u0103torilor, neurmate de vreo form\u0103 de atragere a r\u0103spunderii, afecteaz\u0103 \u00een mod negativ exercitarea votului.<\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">\u00cen acela\u0219i timp, se impune <strong>renun\u021barea la practica organiz\u0103rii simultane a alegerilor de tipuri diferite<\/strong> \u0219i asigurarea unei interpret\u0103ri uniforme a legisla\u021biei \u00een toate sec\u021biile de votare, inclusiv \u00een diaspora. Consider\u0103m c\u0103 experien\u021ba comas\u0103rii alegerilor ne arat\u0103 c\u0103 aceasta este o gre\u0219eal\u0103 din toate punctele de vedere.<\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">De\u0219i referirea la legisla\u021bia electoral\u0103 se refer\u0103, \u00een majoritatea ei, la respectarea dreptului de a alege, aceasta vizeaz\u0103 \u0219i dreptul de a fi ales. Acest drept este limitat prin num\u0103rul mare de semn\u0103turi necesare pentru depunerea unei candidaturi. Un alt element este p\u0103strarea obligativit\u0103\u021bii str\u00e2ngerii de semn\u0103turi \u00een format fizic, de\u0219i chiar \u0219i institu\u021biile statului tind s\u0103 se digitalizeze din ce \u00een ce mai mult. <strong>Reducerea num\u0103rului de semn\u0103turi \u00een mod semnificativ \u0219i permiterea depunerii candidaturii cu semn\u0103turi \u00een format electronic ar contribui la o competi\u021bie electoral\u0103 real\u0103.<\/strong> \u00cen orice caz, p\u00e2n\u0103 la ob\u021binerea acestor deziderate, este imperios necesar\u0103 o procedur\u0103 de verificare a semn\u0103turilor, condi\u021bia num\u0103rului de sus\u021bin\u0103tori fiind un formalism iluzoriu dac\u0103 acestea pot fi falsificate f\u0103r\u0103 consecin\u021be legale, m\u0103car \u00een sensul descalific\u0103rii candidaturii.<\/p>\r\n\r\n\r\n\r\n<blockquote>\r\n<p class=\"p2 wp-block-paragraph\">Experien\u021ba acumulat\u0103 ne-a ar\u0103tat importan\u021ba rolului observatorilor independen\u021bi nu doar \u00een constatarea pasiv\u0103 a procesului electoral, ci \u0219i \u00een ameliorarea acestui proces prin formularea de \u00eent\u00e2mpin\u0103ri \u0219i pl\u00e2ngeri. Solicit\u0103m reglement\u0103ri mai explicite privind accesul observatorilor \u00een sec\u021biile de votare, sanc\u021biuni eficiente pentru obstruc\u021bionarea activit\u0103\u021bii acestora \u0219i consultarea sistematic\u0103 a organiza\u021biilor acreditate \u00een procesul de reform\u0103 electoral\u0103.<\/p>\r\n<\/blockquote>\r\n\r\n\r\n\r\n<p class=\"wp-block-paragraph\">&nbsp;<\/p>\r\n<p class=\"p2\">Pentru \u00eembun\u0103t\u0103\u021birea procesului de vot \u0219i a centraliz\u0103rii rezultatelor, propunem simplificarea procedurilor de num\u0103rare \u0219i centralizare a voturilor, introducerea unor mecanisme suplimentare de control reciproc, accelerarea solu\u021bion\u0103rii contesta\u021biilor \u0219i prelungirea activit\u0103\u021bii birourilor electorale p\u00e2n\u0103 la finalizarea tuturor procedurilor administrative \u0219i judiciare &#8211; care s\u0103 condi\u021bioneze validarea rezultatelor alegerilor. Participarea la observarea alegerilor din Republica Moldova a relevat un sistem mult mai dinamic, cu ar\u0103tarea tuturor buletinelor de vot c\u0103tre to\u021bi participan\u021bii. <strong>Experien\u021bele noastre din Republica Moldova \u0219i Ungaria au relevat, de asemenea, faptul c\u0103 preg\u0103tirea, \u00een\u021belegerea scopului legii \u0219i proactivitatea personalului au fost de natur\u0103 s\u0103 eficientizeze procedurile, comparativ cu situa\u021biile din \u021bar\u0103, \u00een care at\u00e2t necunoa\u0219terea legii, c\u00e2t \u0219i improviza\u021biile au dus la \u00eent\u00e2rzieri \u0219i erori umane \u00een procesul electoral.<\/strong><\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">O propunere formulat\u0103 \u00eenc\u0103 din anul 2024 prive\u0219te reducerea perioadei de recunoa\u0219tere a dreptului de vot ulterior modific\u0103rii domiciliului \u0219i, implicit, a actului de identitate al aleg\u0103torului. Preciz\u0103m c\u0103 \u00een multe alte cazuri, <strong>institu\u021biile statului iau \u00een considerare modificarea domiciliului \u00eenc\u0103 de a doua zi dup\u0103 modificarea adresei.<\/strong> Restr\u00e2ngerea sau limitarea dreptului de vot care pleac\u0103 de la o prezum\u021bie de fraud\u0103 este gre\u0219it\u0103. Suger\u0103m, printre altele, introducerea unei solu\u021bii legislative care s\u0103 acopere \u201epun\u021bile&#8221; dintre vizele de re\u0219edin\u021b\u0103, cu un termen de gra\u021bie de 3 luni \u00eentre expirarea vizei \u0219i re\u00eennoirea acesteia, respectiv reglementarea termenelor limit\u0103 pentru ob\u021binerea vizei \u00een timp util, astfel \u00eenc\u00e2t aleg\u0103torii s\u0103 aib\u0103 un termen rezonabil de conformare<span class=\"s3\">. <\/span><\/p>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Eficien\u021ba mijloacelor judiciare de contestare sau de control al procesului electoral este extrem de important\u0103. Lipsirea de mijloace legale \u0219i procedurale afecteaz\u0103 \u00eencrederea \u00een procesul electoral. <strong>\u00cen acest sens, este necesar\u0103 prelungirea termenelor de validare a alegerilor, astfel \u00eenc\u00e2t acestea s\u0103 fie ulterioare solu\u021bion\u0103rii contesta\u021biilor formulate.<\/strong><\/p>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading p2 has-vivid-cyan-blue-color has-text-color has-link-color wp-elements-5c2afb979ce196380ace7c6b7c9509e1\"><b>2. Transparen\u021ba finan\u021b\u0103rii politice \u0219i aplicarea reglement\u0103rilor europene privind publicitatea politic\u0103 <\/b><b><\/b><\/h2>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Monitorizarea campaniilor electorale din 2024 \u0219i 2025 a relevat deficien\u021be structurale majore \u00een ceea ce prive\u0219te transparen\u021ba finan\u021b\u0103rii politice \u0219i reglementarea publicit\u0103\u021bii politice \u00een mediul digital. Aceste deficien\u021be au fost amplificate de adoptarea \u00een regim de urgen\u021b\u0103 a OUG nr. 1\/2025 privind publicitatea politic\u0103, f\u0103r\u0103 consultare cu p\u0103r\u021bile interesate, \u0219i de aplicarea sa problematic\u0103 de c\u0103tre BEC (Biroul Electoral Central).<\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading p2\"><b>Publicitate politic\u0103 neasumat\u0103 \u0219i re\u021bele de pagini false <\/b><b><\/b><\/h3>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Una dintre cele mai grave amenin\u021b\u0103ri identificate \u00een ciclul electoral 2024\u20132025 a fost proliferarea publicit\u0103\u021bii politice neasumate, finan\u021bate prin re\u021bele de pagini anonime. Investiga\u021biile jurnalistice \u0219i monitorizarea realizat\u0103 de organiza\u021bii ale societ\u0103\u021bii civile (Funky Citizens, Expert Forum, Public Record \u0219amd.) au documentat:<\/p>\r\n\r\n\r\n\r\n<ul>\r\n<li class=\"p2\">Pagini comerciale transformate \u00een aparente persoane reale, cu nume rom\u00e2ne\u0219ti \u0219i fotografii de profil generate de AI, utilizate pentru amplificarea artificial\u0103 a candida\u021bilor la alegerile electorale din 2024-2025.<\/li>\r\n<li class=\"p2\">Re\u021bele coordonate de bo\u021bi opera\u021bi din \u021b\u0103ri precum Vietnam, India \u0219i Pakistan, care au generat sute de mii de aprecieri \u0219i comentarii artificiale pe paginile candida\u021bilor.<\/li>\r\n<li class=\"p2\">Modelul de campanie \u201ezero finan\u021bare, zero cheltuieli\u201d declarat de C\u0103lin Georgescu \u00een 2024, care a expus o lacun\u0103 fundamental\u0103 \u00een mecanismele de monitorizare a finan\u021b\u0103rii campaniilor digitale.\r\n\r\n\r\n\r\n<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading p2\"><b>Recomand\u0103ri: <\/b><b><\/b><\/h3>\r\n\r\n\r\n\r\n<ol>\r\n<li class=\"p2\"><b>Responsabilizarea candida\u021bilor \u0219i partidelor <\/b>pentru toate activit\u0103\u021bile digitale care le aduc beneficii electorale dac\u0103 au comisionat direct aceste activit\u0103\u021bi. Legisla\u021bia trebuie s\u0103 stabileasc\u0103 o norm\u0103 clar\u0103: candida\u021bii \u0219i partidele r\u0103spund pentru ac\u021biunile ter\u021bilor care ac\u021bioneaz\u0103 \u00een beneficiul lor.<\/li>\r\n<li class=\"p2\"><strong>Colaborare institu\u021bional\u0103 structurat\u0103\u00a0<\/strong>\u00eentre AEP, ANCOM (Autoritatea Na\u021bional\u0103 pentru Administrare \u0219i Reglementare \u00een Comunica\u021bii) &#8211; \u00een calitate de Coordonator pentru Servicii Digitale, CNA (Consiliul Na\u021bional al Audiovizualului), alte institu\u021bii cu atribu\u021bii \u00een desf\u0103\u0219urarea procesului electoral \u0219i organiza\u021biile societ\u0103\u021bii civile expertizate \u00een monitorizarea spa\u021biului online \u00een perioadele electorale.\u00a0Absen\u021ba capacit\u0103\u021bii institu\u021bionale de monitorizare sistematic\u0103 a spa\u021biului online r\u0103m\u00e2ne o caren\u021b\u0103 major\u0103: singurii actori care monitorizeaz\u0103 activ \u0219i recurent \u00een prezent spa\u021biul digital \u00een campania electoral\u0103 sunt organiza\u021biile societ\u0103\u021bii civile \u0219i jurnali\u0219tii de investiga\u021bie.\r\n\r\n<\/li>\r\n<\/ol>\r\n\r\n\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading p2\"><b>Responsabilizarea actorilor politici \u00een mediul online <\/b><b><\/b><\/h3>\r\n\r\n\r\n\r\n<ul>\r\n<li class=\"p4\">Consecin\u021be concrete \u0219i sanc\u021biuni pentru utilizarea coordonat\u0103 a conturilor false \u0219i a re\u021belelor de amplificare artificial\u0103 \u00een campania electoral\u0103.<\/li>\r\n<li class=\"p4\">Implementarea unui set unitar de reguli de campanie electoral\u0103 \u00een mediul online, cu caracter obligatoriu.\r\n\r\n<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading p2\"><b>Capacitate institu\u021bional\u0103 de monitorizare a spa\u021biului digital <\/b><b><\/b><\/h3>\r\n\r\n\r\n\r\n<p class=\"p4 wp-block-paragraph\">Distinc\u021bia clar\u0103 \u00eentre monitorizare \u0219i reglementare: institu\u021biile trebuie s\u0103 observe \u0219i s\u0103 \u00een\u021beleag\u0103 fenomenul, nu neap\u0103rat s\u0103 impun\u0103 restric\u021bii suplimentare \u00een spa\u021biul public (precum situa\u021bia declan\u0219at\u0103 de OUG 1\/2025), av\u00e2nd \u00een vedere existen\u021ba instrumentelor europene legale care acoper\u0103 aceste zone. Monitorizarea prevede inclusiv instrumente de comunicare strategic\u0103, sesiz\u0103ri oficiale \u0219i informarea proactiv\u0103 \u0219i constant\u0103 a publicului cu privire la con\u021binutul care poate afecta integritatea electoral\u0103 \u0219i poate influen\u021ba aleg\u0103torii.<\/p>\r\n\r\n\r\n\r\n<h3 class=\"wp-block-heading p2\"><b>Colaborarea AEP cu societatea civil\u0103 <\/b><b><\/b><\/h3>\r\n\r\n\r\n\r\n<ul>\r\n<li class=\"p4\">Consultarea sistematic\u0103 a organiza\u021biilor cu experien\u021b\u0103 \u00een monitorizarea spa\u021biului online electoral \u00een procesul de elaborare a reglement\u0103rilor.<\/li>\r\n<li class=\"p4\">Organizarea de sesiuni de schimb de bune practici cu personalul institu\u021biilor, valorific\u00e2nd expertiza societ\u0103\u021bii civile acumulat\u0103 \u00een ultimii ani de observare electoral\u0103 hibrid\u0103 (acoperire fizic\u0103 a sec\u021biilor de votare \u0219i monitorizare online a campaniilor electorale).\r\n\r\n<\/li>\r\n<\/ul>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading p2 has-vivid-cyan-blue-color has-text-color has-link-color wp-elements-d01303f793c6ff788f043651cb49e862\"><b>3. Elaborarea proiectului de lege privind partidele politice <\/b><b><\/b><\/h2>\r\n\r\n\r\n\r\n<p class=\"p2 wp-block-paragraph\">Ca o observa\u021bie preliminar\u0103, v\u0103 rug\u0103m s\u0103 aprecia\u021bi oportunitatea abrog\u0103rii art. 46 alin. (2) din legea nr. 14\/2003, care este par\u021bial c\u0103zut \u00een desuetudine, prin aplicarea arbitrar\u0103 \u0219i neuniform\u0103 de c\u0103tre Ministerul Public. Aceast\u0103 situa\u021bie este de natur\u0103 s\u0103 creeze incertitudine \u00een ceea ce prive\u0219te dreptul la asociere \u0219i dreptul de a fi ales.<\/p>\r\n\r\n\r\n\r\n<h2 class=\"wp-block-heading p2 has-vivid-cyan-blue-color has-text-color has-link-color wp-elements-d7f12748e344abb94d321ded01080bc1\"><b>4.
