Prin preluarea acestui mecanism de control \u0219i verificare disciplinar\u0103 la Ministerul Justi\u021biei, Executivul devine \u201et\u0103tucul\u201d carierelor magistra\u021bilor, d\u00e2ndu-\u0219i astfel control cvasi-total asupra deciziilor lor. Pu\u021bin neconstitu\u021bional, a\u0219a\u2026<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Introducerea obliga\u021biei de verificare ierarhic\u0103 a TUTUROR actelor\/m\u0103surilor\/solu\u021biilor dispuse de procurorii de caz. Independen\u021ba lor, pentru care societatea a luptat ani de zile, este \u00een pericol, din moment ce \u0219efii procurorilor vor viza munca lor at\u00e2t pe legalitate c\u00e2t \u0219i pe temeinicie. Adic\u0103 PE FOND. Pu\u021bin neeuropean, a\u0219a\u2026<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">Aducerea prerogativei de numire a procurorilor-\u0219efi de la Pre\u0219edinte la Ministerul Justi\u021biei. Pe principiul \u201e\u00eei avem pe cei care te controleaz\u0103 dac\u0103 nu e\u0219ti ascult\u0103tor, acum s\u0103 \u00eei numim \u0219i pe \u0219efii t\u0103i, cei de care trebuie s\u0103 ascul\u021bi\u201d. Pu\u021bin abuziv, a\u0219a&#8230;<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Puterea fiec\u0103ruia dintre cei trei \u201edragoni ai lui Tudorel\u201d este uria\u0219\u0103, dar \u00eempreun\u0103 sunt devastatori pentru Justi\u021bie a\u0219a cum o \u0219tim noi ast\u0103zi. <\/span><\/p>\n<p><b>Exerci\u021biu de imagina\u021bie cu trei dragoni atac\u00e2nd: <\/b>s<span style=\"font-weight: 400;\">e f\u0103cea c\u0103 un partid a c\u00e2\u0219tigat alegerile \u0219i \u0219i-a f\u0103cut Guvern. Ministrul Justi\u021biei, membru de partid, a numit procurorii-\u0219efi. Cei proasp\u0103t numi\u021bi primesc nu dreptul, ci obliga\u021bia de a verifica activitatea procurorilor din subordine. Direct, \u00een cazuri concrete. Caz cu caz. \u00centr-un Parchet, s\u0103 zicem DNA, un procuror investiga un caz de corup\u021bie. Cel vizat era, s\u0103 zicem, un primar de la noua \u201cputere\u201d. Case closed, vorba comisarului \u0218oric. <\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Sun\u0103 ca un film pe care l-am mai v\u0103zut, din p\u0103cate.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">Ei bine, \u00een povestea de mai sus const\u0103, \u00een esen\u021b\u0103, r\u0103ul suprem ascuns \u00een ppt-ul lui Tudorel Toader.<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\"><br \/>\n<\/span><span style=\"font-weight: 400;\">\u00cen plus, o analiz\u0103 mai general\u0103 relev\u0103 un trend &#8211; exprimat prin m\u0103surile de mai sus dar \u0219i prin altele &#8211; de a scoate procurorul, pentru moment cu jum\u0103tate de pas, din r\u00e2ndul magistra\u021bilor \u0219i de sub autoritatea puterii judec\u0103tore\u0219ti \u0219i de a-l aduce pe acesta sub tutela puterii executive. Este asta parte din noua politic\u0103 penal\u0103 a statului? Nu \u0219tim, dar putem b\u0103nui. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Merg\u00e2nd mai departe cu specula\u021bia, o atare modificare \u00een arhitectura institu\u021bional\u0103 ar putea anun\u021ba chiar o schimbare chiar mai profund\u0103 a statului. Interesul personal al func\u0163ionarului public cuprinde orice avantaj pentru el \u00eensu\u015fi sau ea \u00eens\u0103\u015fi sau \u00een favoarea familiei sale, a p\u0103rin\u0163ilor, prietenilor sau persoanelor apropriate, sau a persoanelor sau organiza\u0163iilor cu care el sau ea au avut rela\u0163ii de afaceri sau politice. Legisla\u021bia actual\u0103 (art. 339 Cpp) instituie dreptul oric\u0103rui suspect\/inculpat de-a cere ca actele\/m\u0103surile\/solu\u021biile procurorului de caz s\u0103 fie verificate de procurorul ierarhic superior. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Esen\u021bial\u0103 este ambiguitatea art. 339 Cpp, care nu prevede ce anume poate fi verificat de procurorul ierarhic superior: legalitatea sau temeinicia.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cen Codul de procedur\u0103 penal\u0103, anumite m\u0103suri dispuse de procuror pot fi verificate la cererea persoanei cercetate de procurorul ierarhic superior doar pe criterii de legalitate (\u00een cazul re\u021binerii); \u00een altele, superiorul procurorului de caz apare din oficiu (rechizitoriul, care trebuie verificat at\u00e2t pe legalitate c\u00e2t \u0219i pe temeinicie), iar \u00een altele superiorul ierarhic nu apare deloc (sechestrul sau controlul judiciar, m\u0103suri ale procurorului de caz ce pot fi contestate doar la judec\u0103tor).<\/span><\/p>\n<p>Textul din acest slide unific\u0103 procedura de verificare, at\u00e2t pe legalitate, c\u00e2t \u0219i pe temeinicie, duc\u00e2nd la obligativitatea verific\u0103rii ierarhice a tuturor actelor\/m\u0103surilor\/solu\u021biilor dispuse de procurorul de caz.<\/p>\n<p><span style=\"font-weight: 400;\">Pe l\u00e2ng\u0103 probleme s\u0103 spunem organizatorice, care ar afecta cursivitatea \u0219i celeritatea urm\u0103ririi penale, pe fond o astfel de m\u0103sur\u0103 ar putea genera tenta\u021bia unui abuz fa\u021b\u0103 de procurorul de caz. Putem a\u0219adar s\u0103 vorbim despre un atentat la independen\u021ba procurorilor, sintagm\u0103 pe care nu am mai auzit-o dec\u00e2t rar din 2005-07, c\u00e2nd era o tem\u0103 predilect\u0103 \u00een discu\u021biile despre sistemul judiciar. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Nu mai vorbim de faptul c\u0103 toate actele procurorului sunt ast\u0103zi supuse controlului judec\u0103torului de drepturi \u0219i libert\u0103\u021bi sau judec\u0103torului de camer\u0103 preliminar\u0103, institu\u021bii juridice recent ap\u0103rute \u0219i bine primite de practicieni.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Consider\u0103m c\u0103 nu are sens ca procurorul ierarhic superior s\u0103 dubleze munca unui magistrat judec\u0103tor. Alternativa ar fi s\u0103 p\u0103str\u0103m m\u0103sura propus\u0103 \u00een acest slide, dar s\u0103 elimin\u0103m verific\u0103rile judec\u0103tore\u0219ti \u00eenscrise \u00een noile Coduri, ceea
