Un rezumat grafic cu principalele modific\u0103ri (verde = nou \/ ro\u0219u = mai r\u0103u \/ gri = atrofiat)<\/p>\n<p><img class=\"aligncenter size-large wp-image-3463\" src=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/legile-justitiei-funky-parlament-1024x595.png\" alt=\"\" width=\"1024\" height=\"595\" srcset=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/legile-justitiei-funky-parlament-1024x595.png 1024w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/legile-justitiei-funky-parlament-300x174.png 300w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/legile-justitiei-funky-parlament-768x447.png 768w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/legile-justitiei-funky-parlament.png 1080w\" sizes=\"(max-width: 1024px) 100vw, 1024px\" \/><iframe src=\"https:\/\/docs.google.com\/spreadsheets\/d\/e\/2PACX-1vRDRebBbPX5HQBdiZWXk6Joys4ktscUFeR-rtD3geI8bPSuKUcHAzN6tYNWdvA31p_zpuPZpJwKxRzM\/pubhtml?widget=true&amp;headers=false\" width=\"800\" height=\"600\"><\/iframe><\/p>\n<p><span style=\"font-weight: 400;\">Noua propunere de modificare a \u201elegilor justi\u021biei\u201d &#8211; asumat\u0103 acum de un grup de parlamentari, \u00een locul ministrului de resort &#8211; reprezint\u0103 deopotriv\u0103 o <\/span><i><span style=\"font-weight: 400;\">metamorfoz\u0103 <\/span><\/i><span style=\"font-weight: 400;\">\u0219i o <\/span><i><span style=\"font-weight: 400;\">temporizare <\/span><\/i><span style=\"font-weight: 400;\">\u00een raport cu proiectul anterior (pe care <a href=\"https:\/\/funky.ong\/en\/analiza-a-proiectului-noilor-legi-ale-justitiei\/\">l-am analizat<\/a> la \u00eenceput de septembrie). \u00cen r\u00e2ndurile urm\u0103toare, explic\u0103m din ce motive credem c\u0103 sunt potrivite aceste dou\u0103 caracteriz\u0103ri, precum \u0219i cele mai mari pericole pe care le observ\u0103m \u00een acest stadiu al reformei.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"><strong>Modificarea \u201elegilor justi\u0163iei\u201d a fost pus\u0103, \u00een a doua jum\u0103tate a anului 2017, sub semnul urgen\u0163ei.<\/strong> Emula\u0163ia intelectual\u0103 din spa\u0163iul public, catalizat\u0103 de aceast\u0103 \u201eurgen\u0163\u0103,\u201d a stimulat propunerea unor modific\u0103ri bune, g\u00e2ndite a\u015fezat de-a lungul timpului, utile pentru mai buna func\u0163ionare a justi\u0163iei (cam 160 \u00een total, \u00een ambele proiecte), dar \u015fi la propunerea unor modific\u0103ri insuficient g\u00e2ndite, produse la repezeal\u0103, controversate sau chiar inacceptabile (cam 50 \u00een total). <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"color: #993366;\"><em><span style=\"font-weight: 400;\">\u00cen opinia noastr\u0103, pre\u0219edin\u021bii partidelor parlamentare ar trebui s\u0103 se poat\u0103 \u00een\u021belege asupra legifer\u0103rii pachetului de solu\u021bii consensuale, utile \u00een primul r\u00e2nd cet\u0103\u021beanului-justi\u021biabil, p\u0103str\u00e2nd \u00een procedura legislativ\u0103 doar propunerile care contribuie la mai buna func\u021bionare a justi\u021biei. Pentru celelalte propuneri, credem c\u0103 se poate ajunge la o solu\u021bie bine chibzuit\u0103 (eventual \u00een februarie-martie 2018), printr-o dezbatere a\u0219ezat\u0103, cu argumente, \u00eentre actorii politici, asocia\u021biile profesionale ale magistra\u021bilor \u0219i reprezentan\u021bii celorlal\u021bi factori interesa\u021bi.<\/span><\/em><\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><i><span style=\"font-weight: 400;\">Metamorphosis <\/span><\/i><\/h2>\n<p><span style=\"font-weight: 400;\">Proiectul parlamentar pentru modificarea \u201elegilor justi\u021biei\u201d reprezint\u0103 o <\/span><i><span style=\"font-weight: 400;\">metamorfoz\u0103<\/span><\/i><span style=\"font-weight: 400;\">: Fa\u021b\u0103 de textul precedent, dispar c\u00e2teva propuneri-cheie privind controlul politic asupra magistra\u021bilor. Dar \u201ece-am luat pe mere am dat pe pere,\u201d pentru c\u0103, \u00een egal\u0103 m\u0103sur\u0103, dispar foarte multe prevederi care, pe fond, ar fi reprezentat un progres cert pentru Justi\u021bie. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Dintre noile propuneri de modificare, <span style=\"color: #ff0000;\"><strong>ni se pare extrem de periculos noul mecanism de revocare a membrilor CSM, total netransparent<\/strong>.<\/span> A\u0219a cum ar\u0103t\u0103m mai jos, \u00een categoria <\/span><i><span style=\"font-weight: 400;\">Riscuri<\/span><\/i><span style=\"font-weight: 400;\">, odat\u0103 legiferat, acest nou mecanism de revocare ar putea vulnerabiliza la maximum forul reprezentativ al magistra\u021bilor, al concet\u0103\u021benilor no\u0219tri \u00eenvesti\u021bi cu \u00eencrederea de-a exercita puterea judec\u0103toreasc\u0103 \u00een statul rom\u00e2n.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Alt element de risc este reprezentat de propunerile menite s\u0103 ad\u00e2nceasc\u0103, dincolo de litera \u0219i spiritul <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/1413#id_artA735_ttl\"><span style=\"font-weight: 400;\">art. 133 \u0219i 134<\/span><\/a><span style=\"font-weight: 400;\"> din Constitu\u021bie, <span style=\"color: #ff0000;\"><strong>segregarea CSM pe Sec\u021bii complet separate pentru judec\u0103tori \u0219i procurori.<\/strong><\/span> Odat\u0103 cu eventuala adoptare a acestor m\u0103suri, deciziile-cheie privind cariera magistra\u021bilor se vor lua opac, \u00een Sec\u021biile separate pentru judec\u0103tori \u0219i procurori, departe de cet\u0103\u021beni, \u00een locul formulei actuale, transparente, \u00een Plenul CSM, ale c\u0103rui \u0219edin\u021be pot fi urm\u0103rite online.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><i><span style=\"font-weight: 400;\">Temporizarea <\/span><\/i><\/h2>\n<p><span style=\"font-weight: 400;\">\u00cen egal\u0103 m\u0103sur\u0103, \u00een varianta parlamentar\u0103, \u201elegile justi\u021biei\u201d reprezint\u0103 o <\/span><i><span style=\"font-weight: 400;\">temporizare<\/span><\/i><span style=\"font-weight: 400;\">: \u00cen ciuda \u201eurgen\u021bei,\u201d care a fost clamat\u0103 \u00een comunicarea public\u0103 pe acest subiect,<span style=\"color: #ff0000;\"><strong> anumite prevederi par s\u0103 fie am\u00e2nate cu bun\u0103 \u0219tiin\u021b\u0103<\/strong><\/span>. De exemplu, reglementarea Inspec\u021biei Judiciare este am\u00e2nat\u0103 cu 6 luni, de\u0219i a fost una dintre cele mai contestate propuneri de la \u00eenceputul toamnei. De o manier\u0103 legislativ\u0103 aproape neserioas\u0103, ni se propune un model institu\u021bional incert al acestei structuri, care ar urma s\u0103 fie reglementat\u0103 ulterior, fiind pus\u0103 sub umbrela unui Consiliu ale c\u0103rui organizare \u0219i func\u021bionare sunt descrise lacunar.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Varianta precedent\u0103 con\u021binea puteri sporite asupra magistra\u021bilor pentru ministrul justi\u021biei, care urma s\u0103 preia Inspec\u021bia Judiciar\u0103 de la autoritatea judec\u0103toreasc\u0103 \u0219i s\u0103 primeasc\u0103 dreptul exclusiv de numire a procurorilor-\u0219efi. \u00cen varianta parlamentar\u0103,<strong><span style=\"color: #339966;\"> Pre\u0219edintele reapare (mai bine zis, r\u0103m\u00e2ne) \u00een schema numirii \u0219efilor de parchete, iar Inspec\u021bia Judiciar\u0103 nu mai vine sub tutela ministrului<\/span>.<\/strong> Dar aparentul compromis \u00een privin\u021ba Inspec\u021biei Judiciare poate fi doar o \u201eparcare\u201d temporar\u0103 a unui subiect prea controversat. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"><strong>Proiectul parlamentar nu reu\u015fe\u015fte s\u0103 clarifice un aspect esen\u0163ial \u00een privin\u0163a Inspec\u0163iei Judiciare: <span style=\"color: #ff0000;\">dac\u0103 va fi o autoritate administrativ\u0103 autonom\u0103 \u00een subordinea Guvernului sau un organism autonom \u00een subordinea Parlamentului<\/span><\/strong><span style=\"color: #ff0000;\">,<\/span> pentru c\u0103 textul constitu\u0163ional nu permite alte variante (\u00een afara actualei organiz\u0103ri \u00een subordinea CSM). Mai \u00eenainte de aceast\u0103 alegere, \u00eens\u0103, este nevoie s\u0103 fie clarificate premisele acestei reforme: care este motivul sau scopul mut\u0103rii Inspec\u0163iei, din perspectiva mai bunei func\u0163ion\u0103ri a justi\u0163iei, respectiv dac\u0103 activitatea unui magistrat poate fi inspectat\u0103 de un lucr\u0103tor din afara autorit\u0103\u0163ii judec\u0103tore\u015fti.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><i><span style=\"font-weight: 400;\">Riscurile<\/span><\/i><\/h2>\n<p><span style=\"font-weight: 400;\"><span style=\"color: #339966;\"><strong>Singurul progres remarcabil \u00een varianta parlamentar\u0103 a \u201elegilor justi\u021biei\u201d este renun\u021barea la controlul ierarhic pe temeinicia tuturor deciziilor luate de procurori<\/strong>.<\/span> \u00cen vechea propunere, acest mecanism ar fi putut reprezenta o p\u00e2rghie de control politic asupra activit\u0103\u021bii de urm\u0103rire penal\u0103, tocmai prin coroborare cu numirea procurorilor-\u0219efi de c\u0103tre ministrul justi\u021biei. A\u0219adar, tendin\u021ba abrupt\u0103 de subordonare a magistra\u021bilor este par\u021bial corectat\u0103 prin propunerea parlamentar\u0103, dar \u0219i aceasta con\u021bine c\u00e2teva modific\u0103ri-cheie, de risc major, care ar putea deveni p\u00e2rghii de amestec politic \u00een treburile autorit\u0103\u021bii judec\u0103tore\u0219ti. \u00a0<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">\u00cen opinia noastr\u0103, segregarea extrem\u0103 a magistra\u021bilor, \u00een Sec\u021biile CSM, reprezint\u0103 un alt pas c\u0103tre dezideratul pe care-l intuiam \u00een varianta anterioar\u0103: dezbr\u0103carea procurorilor de statutul lor de magistra\u021bi. Prin noile propuneri, <span style=\"color: #ff0000;\"><strong>Plenul CSM pierde, \u00een favoarea Sec\u021biilor pentru judec\u0103tori \u0219i procurori, toate prerogativele care privesc numirea procurorilor-\u0219efi de la Parchetul \u00cenaltei Cur\u021bi \u0219i Direc\u021biile specializate<\/strong><\/span>, respectiv numirea pre\u0219edintelui \u00cenaltei Cur\u021bi, dar \u0219i multe dintre cele privind cariera. Astfel, se poate ajunge \u00een situa\u021bia de a avea, <\/span><i><span style=\"font-weight: 400;\">de facto<\/span><\/i><span style=\"font-weight: 400;\">, un consiliu al judec\u0103torilor separat de consiliul procurorilor, la fel ca \u00een Moldova sau Bulgaria, dou\u0103 \u021b\u0103ri care \u00ee\u015fi inspir\u0103 inten\u0163iile de reform\u0103 \u00een privin\u021ba independen\u021bei \u0219i\/sau impar\u021bialit\u0103\u021bii justi\u021biei chiar din actualul model rom\u00e2nesc.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Propunerea parlamentar\u0103 include un nou mecanism de revocare a membrilor ale\u0219i ai CSM, extrem de periculos: str\u00e2ngerea de semn\u0103turi de la majoritatea electorilor relevan\u021bi pentru acel membru. Apreciem c\u0103 acest mecanism de revocare este un risc major pentru stabilitatea institu\u021bional\u0103 \u0219i eficien\u021ba func\u021bional\u0103 a CSM. Spre deosebire de transparen\u021ba deciziei de a convoca adun\u0103rile generale ale magistra\u021bilor \u0219i a vota \u00een acel cadru formal pentru sau \u00eempotriva retragerii acelui magistrat ales \u00een CSM, o campanie de str\u00e2ngere de semn\u0103turi, informal\u0103 \u0219i opac\u0103, poate avea ca surs\u0103 orice interese (implicit unele oculte). Dac\u0103 mecanismul str\u00e2ngerii de semn\u0103turi ar fi utilizat doar pentru convocarea adun\u0103rilor generale respective, solu\u021bia ar fi mult \u00eembun\u0103t\u0103\u021bit\u0103.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><i><span style=\"font-weight: 400;\">Limit\u0103rile<\/span><\/i><\/h2>\n<p><span style=\"font-weight: 400;\">Alegem s\u0103 nu coment\u0103m fondul propunerilor care privesc mecanismul de acces \u00een profesia de magistrat, consider\u00e2nd c\u0103 magistra\u021bii \u00een\u0219i\u0219i sunt cei mai \u00een m\u0103sur\u0103 s\u0103 fac\u0103 o evaluare \u00een acest sens, pentru c\u0103 ei cunosc cel mai bine at\u00e2t nevoile sistemului, c\u00e2t \u0219i posibilele sincope ce ar putea ap\u0103rea odat\u0103 cu schimb\u0103rile propuse. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Analiza noastr\u0103 nu atinge \u00een niciun fel expunerile de motive pentru fiecare proiect \u00een parte. Nu putem trata explica\u021biile ini\u021biatorilor la acela\u0219i nivel de detaliu din septembrie (<\/span><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/09\/Analiza-legile-justitiei-funky-citizens.pdf\"><span style=\"font-weight: 400;\">pag. 9-13<\/span><\/a><span style=\"font-weight: 400;\">), pentru c\u0103 expunerile de motive au cel mult c\u00e2te o pagin\u0103, ar\u0103t\u00e2nd mai degrab\u0103 dezinteres fa\u021b\u0103 de efectele substan\u021biale \u0219i sistemice ale schimb\u0103rilor preconizate. Evident, aceste expuneri de motive ar fi trebuit s\u0103 con\u021bin\u0103 referiri \u0219i la studii de impact, \u00eens\u0103 nu au fost f\u0103cute nici referiri, nici studii.<\/span><\/p>\n<p>&nbsp;<\/p>\n<h2><i><span style=\"font-weight: 400;\">Concluziile <\/span><\/i><\/h2>\n<p><span style=\"font-weight: 400;\">De\u0219i am criticat dur propunerile din <\/span><a href=\"http:\/\/www.just.ro\/wp-content\/uploads\/2017\/08\/proiect-legile-justitiei.pdf\"><span style=\"font-weight: 400;\">30 august<\/span><\/a><span style=\"font-weight: 400;\"> ale ministrului Toader, \u00een textul ini\u021bial se g\u0103seau aproximativ 140 de propuneri punctuale bune pentru sistemul de justi\u021bie (marcate cu OK \u00een <\/span><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/09\/Analiza-legile-justitiei-funky-citizens.pdf\"><span style=\"font-weight: 400;\">6 septembrie<\/span><\/a><span style=\"font-weight: 400;\">); critica noastr\u0103 se \u00eendrepta asupra celorlalte peste 40 de propuneri, dintre care 15 vizau \u00een mod direct controlul politic asupra justi\u021biei (marcate cu #controlpolitic \u00een <\/span><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/09\/Analiza-legile-justitiei-funky-citizens.pdf\"><span style=\"font-weight: 400;\">6 septembrie<\/span><\/a><span style=\"font-weight: 400;\">). <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\"><span style=\"color: #339966;\"><strong>Varianta parlamentar\u0103 a \u201elegilor justi\u021biei\u201d con\u021bine doar 35 de propuneri punctuale bune<\/strong><\/span>, dintre care numai 16 sunt p\u0103strate din proiectul ini\u021bial de la minister. Al\u0103turi de lacunele din expunerile de motive, absen\u021ba studiilor de impact \u0219i nesocotirea c\u0103ilor fire\u0219ti de promovare a unui proiect de lege de la Guvern spre Parlament, aceast\u0103 evaluare cantitativ\u0103 reprezint\u0103 o dovad\u0103 \u00een plus c\u0103 proiectul a fost \u00eentocmit la repezeal\u0103, sub imperiul unei urgen\u021be care nu e deplin justificat\u0103. <\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Iat\u0103 cum \u201egraba stric\u0103 treaba\u201d: Atragem aten\u021bia c\u0103 <strong><span style=\"color: #ff0000;\">a r\u0103mas complet pe dinafar\u0103 propunerea salutar\u0103 de repara\u021bie a situa\u021biei care privea locuin\u021bele de serviciu (case de la stat) pentru magistra\u021bi<\/span><\/strong>. \u00cen septembrie, ministrul justi\u021biei \u0219i sus\u021bin\u0103torii variantei precedente a \u201elegilor justi\u021biei\u201d ne prezentau aceast\u0103 m\u0103sur\u0103 drept una cu care e imposibil s\u0103 nu fii de acord. Absen\u021ba acestei prevederi din varianta parlamentar\u0103 a \u201elegilor justi\u021biei\u201d poate fi o simpl\u0103 sc\u0103pare de redactare sau o momeal\u0103 \u00eentins\u0103 unei p\u0103r\u021bi din corpul magistra\u021bilor. Al\u0103turi de aceast\u0103 \u201esc\u0103pare,\u201d \u00eens\u0103, propunerea parlamentar\u0103 extinde o sumedenie de drepturi specifice magistra\u021bilor asupra unor categorii de persoane din afara autorit\u0103\u021bii judec\u0103tore\u0219ti.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-weight: 400;\">Un alt argument privind repezeala este c\u0103,<span style=\"color: #ff0000;\"><strong> \u00een cazul \u00eencet\u0103rii deta\u0219\u0103rilor sau cel al revoc\u0103rii membrilor CSM, propunerile parlamentare nu reu\u0219esc s\u0103 transpun\u0103 Deciziile CCR \u00eentr-o reglementare suficient de predictibil\u0103,<\/strong><\/span> de\u0219i corelarea legisla\u021biei cu jurispruden\u021ba CCR a fost principalul argument \u00een favoarea urgen\u021bei cu care aceste legi trebuie schimbate.
