{"id":3465,"date":"2017-11-22T12:30:24","date_gmt":"2017-11-22T10:30:24","guid":{"rendered":"https:\/\/funky.ong\/?p=3465"},"modified":"2026-05-26T17:43:17","modified_gmt":"2026-05-26T14:43:17","slug":"consens-legile-justitiei","status":"publish","type":"post","link":"https:\/\/funky.ong\/en\/consens-legile-justitiei\/","title":{"rendered":"Consens: Legile Justi\u021biei."},"content":{"rendered":"<p><strong>Sinteza discu\u021biilor<\/strong><\/p>\n<p><span style=\"font-weight: 400;\"><img class=\"aligncenter size-full wp-image-3466\" src=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/consens.jpg\" alt=\"\" width=\"602\" height=\"601\" srcset=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/consens.jpg 602w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/consens-150x150.jpg 150w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/consens-300x300.jpg 300w, https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/consens-256x256.jpg 256w\" sizes=\"(max-width: 602px) 100vw, 602px\" \/>\u00cen contextul \u00een care noile Coduri (civil, penal, de procedur\u0103 civil\u0103 \u015fi de procedur\u0103 penal\u0103) au scos la iveal\u0103 o serie de neajunsuri privind organizarea judiciar\u0103, iar Consiliul Superior al Magistraturii a solicitat unele modific\u0103ri ale legisla\u0163iei relevante, ultimul an a stat sub egida mai multor ini\u0163iative de modificare a \u201elegilor justi\u0163iei.\u201d Dup\u0103 consult\u0103rile extinse din cursul anului 2016, respectiv situa\u0163iile tensionate din prim\u0103vara 2017, Ministerul Justi\u0163iei a publicat <\/span><a href=\"http:\/\/www.just.ro\/wp-content\/uploads\/2017\/08\/proiect-legile-justitiei.pdf\"><span style=\"font-weight: 400;\">un prim proiect<\/span><\/a><span style=\"font-weight: 400;\"> la sf\u00e2r\u015fitul lunii august. O parte a acelui proiect a fost preluat\u0103 sub forma unor ini\u0163iative parlamentare, la sf\u00e2r\u015fitul lunii octombrie, rezult\u00e2nd proiecte de modificare pentru Legea <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/64928\"><span style=\"font-weight: 400;\">303\/2004<\/span><\/a><span style=\"font-weight: 400;\"> privind statutul judec\u0103torilor \u015fi procurorilor (<\/span><a href=\"http:\/\/www.cdep.ro\/pls\/proiecte\/upl_pck2015.proiect?idp=16611\"><span style=\"font-weight: 400;\">Pl-x nr. 418\/2017<\/span><\/a><span style=\"font-weight: 400;\">), Legea <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/64951\"><span style=\"font-weight: 400;\">304\/2004<\/span><\/a><span style=\"font-weight: 400;\"> privind organizarea judiciar\u0103 (<\/span><a href=\"http:\/\/www.cdep.ro\/pls\/proiecte\/upl_pck2015.proiect?idp=16610\"><span style=\"font-weight: 400;\">Pl-x nr. 417\/2017<\/span><\/a><span style=\"font-weight: 400;\">) \u015fi Legea <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/64942\"><span style=\"font-weight: 400;\">317\/2004<\/span><\/a><span style=\"font-weight: 400;\"> privind organizarea \u015fi func\u0163ionarea Consiliului Superior al Magistraturii (<\/span><a href=\"http:\/\/www.cdep.ro\/pls\/proiecte\/upl_pck2015.proiect?idp=16612\"><span style=\"font-weight: 400;\">Pl-x nr. 419\/2017<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00centruc\u00e2t au existat voci puternice, reprezentative, at\u00e2t \u00een corpul magistra\u0163ilor, c\u00e2t \u015fi \u00een restul societ\u0103\u0163ii, care au contestat at\u00e2t procesul de elaborare a acestor proiecte, c\u00e2t \u015fi con\u0163inutul lor, Funda\u0163ia Konrad Adenauer \u015fi Programul s\u0103u pentru <\/span><a href=\"http:\/\/www.kas.de\/rlpsee\/ro\/\"><span style=\"font-weight: 400;\">Statul de Drept \u00een Europa de Sud-Est<\/span><\/a><span style=\"font-weight: 400;\">, al\u0103turi de <\/span><a href=\"https:\/\/funky.ong\/en\/\"><span style=\"font-weight: 400;\">Funky Citizens<\/span><\/a><span style=\"font-weight: 400;\"> and <\/span><a href=\"http:\/\/expertforum.ro\/\"><span style=\"font-weight: 400;\">Expert Forum<\/span><\/a><span style=\"font-weight: 400;\">, au organizat \u00een 20-21 noiembrie conferin\u0163a <\/span><i><span style=\"font-weight: 400;\">Consens: Legile Justi\u0163iei<\/span><\/i><span style=\"font-weight: 400;\">. Dezbaterile din cele dou\u0103 zile ale conferin\u0163ei au scos \u00een eviden\u0163\u0103, printre alte probleme legate de cadrul legislativ, nevoia de comunicare, de deschidere a sistemului de justi\u0163ie fa\u0163\u0103 de cet\u0103\u0163eni \u015fi celelate institu\u0163ii ori profesii.<\/span><\/p>\n<p>Deciziile luate de magistra\u0163i trebuie s\u0103 fie mai bine explicate pe \u00een\u0163elesul oamenilor obi\u015fnui\u0163i; nu doar sentin\u0163ele pronun\u0163ate de instan\u0163e, dar \u015fi solu\u0163iile adoptate de procurori. \u00cen cazul concret al hot\u0103r\u00e2rilor judec\u0103tore\u015fti (inclusiv Deciziile Cur\u0163ii Constitu\u0163ionale), ar fi de dorit ca ele s\u0103 fie pronun\u0163ate \u00een \u015fedin\u0163\u0103 public\u0103 abia atunci c\u00e2nd sunt deja motivate, astfel \u00eenc\u00e2t publicul larg s\u0103 \u00een\u0163eleag\u0103 mai bine cum se aplic\u0103 legea. Acest deziderat ar reflecta mai bine valorile fundamentale ale profesiei de magistrat, mai ales cu privire la modul \u00een care se rela\u0163ioneaz\u0103 magistra\u0163ii fa\u0163\u0103 de cet\u0103\u0163eni, justi\u0163ia reprezent\u00e2nd un serviciu public de importan\u0163\u0103 cov\u00e2r\u015fitoare \u00een via\u0163a fiec\u0103rui om.<\/p>\n<p>Concluzia general\u0103 a dezbaterilor din cadrul conferin\u0163ei este c\u0103 modific\u0103rile propuse pentru \u201elegile justi\u0163iei\u201d au nevoie de timp \u015fi r\u0103bdare, pentru a colecta punctele de vedere ale tuturor celor implica\u0163i \u015fi afecta\u0163i. Dac\u0103 sunt organizate cu tact \u015fi pe \u00eendelete, astfel \u00eenc\u00e2t s\u0103 ofere \u015fanse de participare tuturor celor interesa\u0163i, dezbaterile privind proiectele de modificare scot la iveal\u0103 subiecte, riscuri sau beneficii, care ar fi putut sc\u0103pa din aten\u0163ia ini\u0163iatorilor. Din aceste motive, preconizata adoptare a \u201elegilor justi\u0163iei\u201d \u00een procedura de urgen\u0163\u0103 \u201eaccelerat\u0103\u201d se poate dovedi un nou e\u015fec de legiferare, cu efecte nocive asupra sistemului de justi\u021bie. Politicile publice consistente \u0219i solide nu pot fi realizate \u00een regim de urgen\u021b\u0103.<\/p>\n<p><span style=\"font-weight: 400;\">===<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Programul conferin\u0163ei a fost g\u00e2ndit cu scopul de a facilita identificarea unor solu\u0163ii consensuale pentru c\u00e2teva dintre cele mai controversate propuneri de modificare. Astfel, \u00een cadrul atelierelor de lucru din 20 noiembrie, au fost discutate subiecte precum organizarea Inspec\u0163iei Judiciare, regimul incompatibilit\u0103\u0163ilor \u015fi interdic\u0163iilor aplicabile auditorilor de justi\u0163ie (studen\u0163ii de la Institutul National al Magistraturii), regimul deleg\u0103rilor \u015fi deta\u015f\u0103rilor pentru magistra\u0163i, alegerea \u015fi revocarea membrilor CSM, atribu\u0163iile \u015fi v\u00e2rsta magistra\u0163ilor stagiari, respectiv gestionarea carierei magistra\u0163ilor. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Fiecare atelier de lucru a inclus o fi\u015f\u0103 tematic\u0103 \u00een care au fost expuse comparativ problemele \u015fi efectele posibile ale modific\u0103rii legisla\u0163iei, respectiv \u00eentreb\u0103rile care ar putea facilita g\u0103sirea unei solu\u0163ii. Fi\u015fele tematice au cuprins, \u00een anex\u0103, extrase din <\/span><a href=\"https:\/\/funky.ong\/en\/legile-justitiei-metamorfoza\/\"><span style=\"font-weight: 400;\">analiza comparativ\u0103<\/span><\/a><span style=\"font-weight: 400;\"> realizat\u0103 de Funky Citizens, \u00een care proiectele de modificare (varianta ministerial\u0103 \u015fi varianta parlamentar\u0103) sunt puse fa\u0163\u0103 \u00een fa\u0163\u0103 cu prevederile legale \u00een vigoare.<\/span><\/p>\n<p>Concluziile dezbaterilor din fiecare atelier au fost prezentate \u00een cadrul dezbaterii finale, din 21 noiembrie, \u00een fa\u0163a unui auditoriu compus din reprezentan\u0163i ai institu\u0163iilor publice relevante, ai asocia\u0163iilor profesionale de magistra\u0163i, ai mediului academic (profesori de drept, etic\u0103, economie) \u015fi ai organiza\u0163iilor societ\u0103\u0163ii civile.<\/p>\n<h3>Inspec\u021bia judiciar\u0103<\/h3>\n<p><strong><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/Atelier-1-Inspectia.pdf\">Atelier 1 &#8211; Inspectia<\/a>\u00a0&#8211; Fi\u0219a atelierului<\/strong><\/p>\n<p>Discu\u0163iile din cadrul atelierul au identificat drept corect\u0103 premisa c\u0103 activitatea unui magistrat poate fi verificat\u0103 ori inspectat\u0103 numai de un alt magistrat. Prin urmare, Inspec\u0163ia Judiciar\u0103 nu poate func\u0163iona dec\u00e2t \u00een interiorul autorit\u0103\u0163ii judec\u0103tore\u015fti, iar modelele institu\u0163ionale de la CNI\/ANI, CNCD sau CNSAS nu mai sunt relevante \u00een discu\u0163ie, dup\u0103 cum nu mai este foarte relevant\u0103 nici lipsa de claritate a modific\u0103rilor propuse.<\/p>\n<p><span style=\"font-weight: 400;\">Chiar dac\u0103 ar deveni un organism autonom independent, Inspec\u0163ia Judiciar\u0103 ar trebui s\u0103 r\u0103m\u00e2n\u0103 sub autoritatea sau m\u0103car sub coordonarea Consiliului Superior al Magistraturii, astfel \u00eenc\u00e2t s\u0103 poat\u0103 fi respectat\u0103 cerin\u0163a ca inspectorii judiciari s\u0103 r\u0103m\u00e2n\u0103 cu statutul de magistrat. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Participan\u0163ii au c\u0103zut de acord c\u0103 exist\u0103 o vulnerabilitate \u00een privin\u0163a procesului de recrutare a inspectorilor judiciari. Solu\u0163ia corelativ\u0103 ar putea fi recrutarea prin intermediul Institutului National al Magistraturii, pentru a elimina eventualele suspiciuni privind leg\u0103turile dintre inspectorii judiciari \u015fi inspectorul-\u015fef. O analiz\u0103 a tuturor vulnerabilit\u0103\u0163ilor ar putea fi de bun augur, pentru a putea fundamenta modific\u0103ri legislative complete \u015fi eficiente.<\/span><\/p>\n<h3><b>Incompatibilit\u0103\u0163i pentru auditorii de justi\u0163ie<\/b><\/h3>\n<p><strong><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/Atelier-2-Incompatibilitati.pdf\">Atelier 2 &#8211; Incompatibilitati<\/a>\u00a0&#8211; Fi\u0219a atelierului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Discu\u0163iile din cadrul atelierului au explorat diferen\u0163ele de filozofie dintre cadrul legal existent pentru intrarea \u00een magistratur\u0103 (2 ani ca auditor + 1 an ca stagiar) \u015fi cel propus \u00een varianta parlamentar\u0103 (4 ani ca auditor + 2 ani ca stagiar). Situa\u0163ia magistra\u0163ilor stagiari a fost tratat\u0103 separat, \u00een atelierul 5. Stagiile de preg\u0103tire practic\u0103 (de c\u00e2te 6 luni) ale auditorilor de justi\u0163ie nu au o reglementare suficient\u0103 \u00een noile propuneri, tocmai din cauza diferen\u0163ei de abordare, la nivel conceptual. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pentru a se putea aplica o sanc\u0163iune pentru abatere disciplinar\u0103, \u00een noua filozofie a preg\u0103tirii practice de la nivelul INM, este nevoie ca textul de lege s\u0103 con\u0163in\u0103 o interdic\u0163ie expres\u0103. Astfel, participan\u0163ii consider\u0103 c\u0103 ar fi oportun\u0103 introducerea \u00een lege a unui set de interdic\u0163ii, inspirat din punctul de vedere <\/span><a href=\"http:\/\/www.inm-lex.ro\/fisiere\/d_179\/Punct%20de%20vedere%20CSM%20incompatibilitati%20si%20interdictii%20auditori.pdf\"><span style=\"font-weight: 400;\">exprimat<\/span><\/a><span style=\"font-weight: 400;\"> de CSM \u00een noiembrie 2011 \u015fi din <\/span><a href=\"http:\/\/www.inm-lex.ro\/fisiere\/d_179\/Statutul%20auditorilor%20de%20justiei.doc\"><span style=\"font-weight: 400;\">Statutul auditorilor de justi\u0163ie<\/span><\/a><span style=\"font-weight: 400;\">, adoptat de Consiliul \u0219tiin\u021bific al INM \u00een decembrie 2008. \u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pentru o deplin\u0103 corelare cu alte prevederi legale \u00een vigoare, odat\u0103 ce ar fi introduse astfel de interdic\u0163ii, auditorii de justi\u0163ie ar trebui s\u0103 aib\u0103 \u015fi obliga\u0163ia de a depune cel pu\u0163in declara\u0163ii de interese, poate \u015fi declara\u0163ii de avere. O astfel de m\u0103sur\u0103 ar contribui \u00een egal\u0103 m\u0103sur\u0103 la cre\u015fterea capacit\u0103\u0163ii de monitorizare a interdic\u0163iilor, dar \u015fi la con\u015ftientizarea responsabilit\u0103\u0163ilor unui magistrat, \u00eenc\u0103 de la primul nivel de preg\u0103tire, din stadiul de auditor.<\/span><\/p>\n<h3><strong>Deleg\u0103ri \u0219i deta\u0219\u0103ri<\/strong><\/h3>\n<p><strong><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/Atelier-3-Delegari-si-detasari.pdf\">Atelier 3 &#8211; Delegari si detasari<\/a>\u00a0&#8211; Fi\u0219a atelierului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">De principiu, m\u0103sura deta\u015f\u0103rii magistra\u0163ilor trebuie s\u0103 r\u0103m\u00e2n\u0103 aplicabil\u0103 doar ca excep\u0163ie \u015fi doar temporar. Tot la nivel de principiu, ar trebui evitat\u0103 deta\u015farea magistra\u0163ilor \u00een afara institu\u0163iilor din cadrul autorit\u0103\u0163ii judec\u0103tore\u015fti. Deficitul de personal din magistratur\u0103 (aproape 600 de judec\u0103tori \u015fi peste 400 de procurori) \u00eent\u0103re\u015fte consensul participan\u0163ilor pozi\u0163iilor de principiu deja exprimate.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">\u00cen situa\u0163iile excep\u0163ionale \u00een care se impune ori este oportun\u0103 deta\u015farea unui magistrat, trebuie luate \u00een considerare nevoile de personal ale institu\u0163iei din care pleac\u0103 magistratul, dar \u015fi atribu\u0163iile din fi\u015fa postului c\u0103tre care pleac\u0103 magistratul. Astfel, participan\u0163ii sunt de acord c\u0103 este inacceptabil\u0103 ocuparea de c\u0103tre magistra\u0163i a unor func\u0163ii cu \u00eenc\u0103rc\u0103tur\u0103 politic\u0103 (ministru, secretar sau subsecretar de stat, consilier al unui demnitar, consul sau ambasador etc.) ori a unor func\u0163ii al c\u0103ror mecanism de numire este politizat (pre\u015fedinte de agen\u0163ie specializat\u0103, \u00een cadrul unei autorit\u0103\u0163i centrale, prefect sau subprefect etc.).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Participan\u0163ii subliniaz\u0103 c\u0103 m\u0103sura deta\u015f\u0103rii este necesar\u0103 in unele situa\u0163ii punctuale, dar ea nu trebuie abuzat\u0103 cu scopul de-a \u00ab\u00eemprumuta\u00bb la nivel politic din aparen\u0163a de integritate, impar\u0163ialitate, competen\u0163\u0103 \u015fi autoritate pe care o au magistra\u0163ii, pentru c\u0103 s-ar aduce deservicii, concomitent, \u015fi magistraturii, \u015fi palierului politic. \u00cen acest context, participan\u0163ii au apreciat drept pozitiv\u0103 recenta decizie CSM privind limitarea perioadei de deta\u015fare la maximum 6 ani pe \u00eentreaga durat\u0103 a carierei unui magistrat (circa \u00bc din cei 25 de ani necesari pentru ie\u015firea la pensie).<\/span><\/p>\n<h3>Alegerea sau revocarea membrilor CSM<\/h3>\n<p><strong><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/Atelier-4-Revocarea.pdf\">Atelier 4 &#8211; Revocarea<\/a>\u00a0&#8211; Fi\u0219a atelierului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Discu\u0163iile au identificat c\u00e2teva subiecte suplimentare, fa\u0163\u0103 de fi\u015fa tematic\u0103 ini\u0163ial\u0103, cum ar fi imprecizia textului propus cu privire la termenul \u00een care trebuie organizate alegerile pentru succesorul celui revocat ori situa\u0163ia \u00een care nu se prezint\u0103 candida\u0163i pentru ocuparea postului, dac\u0103 restul de mandat este prea scurt. Fa\u0163\u0103 de aceste probleme, participan\u0163ii au sugerat c\u0103 se pot \u00eemprumuta solu\u0163iile legislative consacrate \u00een privin\u0163a Cur\u0163ii Constitu\u0163ionale, at\u00e2t cu privire la durata restului de mandat, c\u00e2t \u015fi la eventuala re\u00eennoire a componen\u0163ei CSM cu c\u00e2te \u2153, din 2 \u00een 2 ani.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Participan\u0163ii au c\u0103zut de acord cu privire la necesitatea \u00eembun\u0103t\u0103\u0163irii comunic\u0103rii CSM cu societatea, at\u00e2t la nivel institu\u0163ional, c\u00e2t \u015fi la nivelul fiec\u0103rui membru individual ales sau numit, cu scopul de a \u00eent\u0103ri caracteristicile definitorii ale CSM: reprezentativitatea, diversitatea \u015fi \u00eendeplinirea <\/span><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/1413#id_artA724_ttl\"><span style=\"font-weight: 400;\">misiunii constitu\u0163ionale<\/span><\/a><span style=\"font-weight: 400;\"> de garant al independen\u0163ei justi\u0163iei. Un rol important al CSM, \u00een privin\u0163a identific\u0103rii \u015fi explic\u0103rii valorilor fundamentale ale profesiei de magistrat, a fost discutat mai pe larg \u00een atelierul 6.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Participan\u0163ii nu au putut concluziona dac\u0103 membrii ale\u015fi ai CSM au un mandat reprezentativ sau imperativ, dar au subliniat nevoia ca exercitarea mandatului s\u0103 se fac\u0103 \u00een egal\u0103 m\u0103sur\u0103 cu responsabilitate \u015fi cu loialitate fa\u0163\u0103 de adun\u0103rile generale ale magistra\u0163ilor. \u00cen privin\u0163a membrilor numi\u0163i ai CSM (reprezentan\u0163ii societ\u0103\u0163ii civile), participan\u0163ii au identificat mai multe probleme care-\u015fi au izvorul \u00een practic\u0103, nu neap\u0103rat \u00een legisla\u0163ie, dar au ar\u0103tat c\u0103 propunerile privind segregarea CSM pe Sec\u0163iile de judec\u0103tori \u015fi procurori pot avea efectul de-a l\u0103sa cei doi membri numi\u0163i ai CSM f\u0103r\u0103 activitate.<\/span><\/p>\n<h3>Atribu\u021biile \u0219i v\u00e2rsta magistra\u021bilor stagiari<\/h3>\n<p><strong><a href=\"https:\/\/funky.ong\/wp-content\/uploads\/2017\/11\/Atelier-5-stagiari.pdf\">Atelier 5 &#8211; stagiari<\/a>\u00a0&#8211; Fi\u0219a atelierului<\/strong><\/p>\n<p><span style=\"font-weight: 400;\">Discu\u0163iile au debutat cu o controvers\u0103 privind nevoia unei experien\u0163e preliminare \u015fi dac\u0103 aceasta poate fi legat\u0103 de un criteriu de v\u00e2rst\u0103. Opinia majoritar\u0103 a fost c\u0103 nu este necesar\u0103 condi\u0163ionarea accesului \u00een magistratur\u0103 de existen\u0163a unei experien\u0163e preliminare, de\u015fi este evident c\u0103 o astfel de experien\u0163\u0103 nu stric\u0103.
