Refacerea pachetului legislativ. O lu\u0103m de la cap\u0103t.<\/h3>\n<p>\u021ain\u00e2nd cont c\u0103 discu\u021bia reform\u0103rii sistemului de justi\u021bie a fost sus\u021binut\u0103 de unii magistra\u021bi, putem lua \u00een considerare necesitatea lu\u0103rii unor m\u0103suri pentru a-l perfec\u021biona. A\u0219adar se pot organiza dezbateri largi \u00een cadrul c\u0103rora s\u0103 se analizeze eventuale modific\u0103ri \u0219i s\u0103 se reevalueze \u00een mod cuprinz\u0103tor \u0219i \u00een mod efectiv amendamentele care merit\u0103 propuse.<\/p>\n<p>Noua ini\u021biativ\u0103 legislativ\u0103 trebuie s\u0103 se baze pe studii sociale credibile \u0219i transparen\u021b\u0103 decizional\u0103, iar procedura de urgen\u021b\u0103 s\u0103 fie exclus\u0103.<\/p>\n<p>&nbsp;<\/p>\n<h3>2. Continuarea procedurii de \u201ec\u00e2rpeal\u0103\u201d legislativ\u0103 prin interven\u021bie asupra OUG 92\/2018 sau prin alte instrumente de urgen\u021b\u0103.<\/h3>\n<ol>\n<li>Guvernul poate s\u0103 dea o nou\u0103 ordonan\u021b\u0103 prin care s\u0103 abroge OUG 92 sau s\u0103 modifice unele prevederi din legile justi\u021biei. A\u0219a cum am v\u0103zut din analiza de mai sus, OUG 92\/2018 nu ia \u00een considerare multe dintre recomand\u0103rile CV, ba mai mult dec\u00e2t at\u00e2t, \u00eenr\u0103ut\u0103\u021be\u0219te situa\u021bia actual\u0103 \u00een unele privin\u021be. Nu ar fi pentru prima dat\u0103 c\u00e2nd Guvernul intervine printr-o ordonan\u021b\u0103 asupra unei alte ordonan\u021be. \u0218i OUG 13 a fost abrogat\u0103 prin OUG 14. Un fel de <em>inception<\/em> legislativ, am putea zice. \u00cen acest caz \u00eens\u0103 e dificil de argumentat urgen\u021ba legislativ\u0103 astfel \u00eenc\u00e2t s\u0103 nu vorbim despre o neconstitu\u021bionalitate a interven\u021biei.<\/li>\n<li>Avocatul Poporului poate s\u0103 sesizeze CCR. \u00centr-o alt\u0103 spe\u021b\u0103 Avocatul Poporului a sesizat CCR cu motivul c\u0103 ,,<em>Guvernul \u00eencearc\u0103 s\u0103 se situeze \u00eentr-o pozi\u0163ie opus\u0103 \u015fi conflictual\u0103 cu Parlamentul\u201d care, \u00een cadrul celor trei puteri, \u201eare o pozi\u0163ie primordial\u0103\u201d, \u00eenf\u0103ptuind func\u0163ia legislativ\u0103 \u015fi gestion\u00e2nd procesul decizional. Func\u0163ia executiv\u0103 realizat\u0103 de Guvern este \u00een mod evident subordonat\u0103 \u015fi controlat\u0103 de Parlament, rolul acestuia fiind acela de \u201ea executa legile\u201d, iar \u201enu de a obstruc\u0163iona aplicarea lor\u201d. \u00cen aceste condi\u0163ii, ordonan\u0163a criticat\u0103 \u201ese prezint\u0103 ca un refuz explicit al Guvernului de a aplica \u015fi executa legea votat\u0103 de c\u0103tre Parlament \u015fi promulgat\u0103 de Pre\u015fedintele Rom\u00e2niei. Prin aceasta se \u00eencalc\u0103 comportamentul constitu\u0163ional loial, comportament care rezult\u0103 din principiul separa\u0163iei \u015fi echilibrului puterilor<\/em>.\u201d<a href=\"#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a> Istoricul nu ne arat\u0103 \u00eens\u0103 o aplecare a Avocatului Poporului \u00eenspre a corecta modalitatea de legiferare prin OUG de la nivelul executivului (prin instrumentul s\u0103u exclusiv de sesizare a ordonan\u021belor de urgen\u021b\u0103 la CCR).<\/li>\n<li>OUG 92\/2018 poate fi modificat\u0103 de Parlament, atunci c\u00e2nd va trece prin procedura de aprobare. \u00cen acest caz, Parlamentul va avea ocazia s\u0103 \u021bin\u0103 cont de toate recomand\u0103rile \u0219i de toate criticile care au fost aduse pachetului legislativ. Problema \u00een aceast\u0103 op\u021biune este \u00eens\u0103 aceea c\u0103 procedura parlamentar\u0103 de aprobare\/ respingere a ordonan\u021belor de urgen\u021b\u0103 este tot una \u00een regim de urgen\u021b\u0103. Aceasta presupune c\u0103 timpul alocat eventualelor dezbateri va fi de asemenea unul redus, iar probabilitatea ca \u0219i \u00een acest caz s\u0103 avem o procedur\u0103 similar\u0103 celei prin care a trecut pachetul legislativ ini\u021bial este foarte ridicat\u0103.<\/li>\n<\/ol>\n<h3>3. Autorit\u0103\u021bile rom\u00e2ne nu vor lua niciun fel de m\u0103suri, ignor\u00e2nd at\u00e2t recomand\u0103rile externe, c\u00e2t \u0219i cele interne.<\/h3>\n<p><strong>\u00a0<\/strong><\/p>\n<p>Dac\u0103 autorit\u0103\u021bile vor opta pentru aceast\u0103 variant\u0103, efectele negative pot fi deosebit de grave.<\/p>\n<h4>1. Impact asupra pozi\u021biei Rom\u00e2niei din Consiliul Europei<\/h4>\n<p>Consiliul Europei, organismul pe l\u00e2ng\u0103 care activeaz\u0103 Comisia de la Vene\u021bia, nu are extrem de multe instrumente la dispozi\u021bie \u0219i o eventual\u0103 excludere este destul de greu de operat. \u00cens\u0103 Consiliul Europei poate aplica inclusiv sanc\u021biuni care merg de la suspendarea unei delega\u021bii na\u021bionale p\u00e2n\u0103 la pierderea dreptului de vot.<\/p>\n<p>&nbsp;<\/p>\n<p>Dincolo de op\u021biunile extreme, este bine s\u0103 amintim inclusiv faptul c\u0103 nu doar puterea legislativ\u0103 este \u021binut\u0103 de recomand\u0103rile CV, dar \u0219i Curtea Constitu\u021bional\u0103 are obliga\u021bia de loialitate constitu\u021bional\u0103 de a valorifica opiniile Comisiei de la Vene\u021bia, a\u0219adar inclusiv \u00een privin\u021ba modific\u0103rilor aduse legilor justi\u021biei. Av\u00e2nd \u00een vedere statutul Rom\u00e2niei de parte la Conven\u021bia European\u0103 a Drepturilor Omului \u0219i de stat membru al Consiliului Europei, recomand\u0103rile Comisiei de la Vene\u021bia nu ar trebui s\u0103 r\u0103m\u00e2n\u0103 f\u0103r\u0103 efecte \u00een plan practic, fiind avute \u00een vedere la \u00eembun\u0103t\u0103\u021birea cadrului normativ, f\u0103r\u0103 ca aceasta s\u0103 echivaleze cu o \u00eenc\u0103lcare a principiului suprema\u021biei Constitu\u021biei Rom\u00e2niei (a se vedea, spre exemplu, Decizia nr. 334 din 26 iunie 2013 a Cur\u021bii Constitu\u021bionale).<\/p>\n<p>&nbsp;<\/p>\n<p>Rom\u00e2nia a aderat la Consiliul Europei (CE) ca urmare a deciziei de la 4 octombrie 1993, formulat\u0103 prin Rezolu\u021bia nr. 37\/1993 a Comitetului de Mini\u0219tri al CE. Aderarea la CE, organiza\u021bie fondat\u0103 pe principiile respectului pentru drepturile \u0219i libert\u0103\u021bile fundamentale ale omului, pentru valorile democra\u021biei \u0219i ale statului de drept, este considerat\u0103 o etap\u0103 important\u0103 \u00een promovarea demersurilor Rom\u00e2niei de aderare la Uniunea European\u0103 (UE) \u0219i la Organiza\u021bia Tratatului Nord-Atlantic (NATO).<\/p>\n<p>&nbsp;<\/p>\n<p>Ignorarea opiniei formulate de Comisia de la Vene\u021bia ar \u00eensemna un pas uria\u0219 \u00eenapoi pentru Rom\u00e2nia, \u021bin\u00e2nd cont c\u0103 rolul acesteia este de acordare prompt\u0103 a unor solu\u021bii constitu\u021bionale \u0219i legislative statelor membre conform standardelor \u0219i bunelor practici \u00een domeniu.<\/p>\n<h4>2. Impact determinat de statutul de stat membru al Uniunii Europene<\/h4>\n<p>\u021ain\u00e2nd cont de criticile dure aduse de c\u0103tre Comisia European\u0103 asupra legisla\u021biei cu impact asupra sistemului judiciar, aceasta ar putea apela la toate p\u00e2rghiile pe care le are la dispozi\u021bie, inclusiv atacarea la Curtea de Justi\u021bie a Uniunii Europene a reglement\u0103rilor contrare tratatului. Comisia European\u0103 poate sesiza Curtea de Justi\u021bie a Uniunii Europene (CJUE) printr-o ac\u021biune \u00een constatatea ne\u00eendeplinirii obliga\u021biilor, \u00een urma c\u0103reia CJUE va putea s\u0103 controleze respectarea de c\u0103tre statele membre a obliga\u0163iilor care le revin \u00een temeiul dreptului Uniunii. \u00cen cazul \u00een care Curtea de Justi\u0163ie constat\u0103 ne\u00eendeplinirea obliga\u0163iilor, Rom\u00e2nia este obligat\u0103 s\u0103 pun\u0103 imediat cap\u0103t acestei situa\u0163ii.
