Organizations, members of civil society, associations and journalists are invited to contribute to the report. Po\u021bi g\u0103si <a rel=\"noreferrer noopener\" href=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/PDF\/?uri=CELEX:52020SC0322&amp;from=EN\" data-type=\"URL\" data-id=\"https:\/\/eur-lex.europa.eu\/legal-content\/RO\/TXT\/PDF\/?uri=CELEX:52020SC0322&amp;from=EN\" target=\"_blank\">here<\/a> raportul pe 2020, la care am contribuit cu drag.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Rezumat:<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Limit\u0103ri<\/strong>: \u00een Rom\u00e2nia, starea de urgen\u021b\u0103 (16 martie &#8211; 15 mai 2020) \u0219i starea ulterioar\u0103 de alert\u0103 (\u00een curs) au adus limit\u0103ri drepturilor fundamentale, dispozi\u021biilor legate de transparen\u021b\u0103 \u00een procesul decizional \u0219i spa\u021biului pentru mecanismele de supraveghere legale (control parlamentar, etc) pentru r\u0103spunsul la criza sanitar\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Lipsa predictibilit\u0103\u021bii<\/strong>: provoc\u0103rile la adresa statul de drept au fost generate de infla\u021bia de OUG-uri (227 de ordonan\u021be de urgen\u021b\u0103 au fost emise \u00een 2020, fa\u021b\u0103 de 89 \u00een 2019 \u0219i 114 \u00een 2018); Rom\u00e2nia are deja o problem\u0103 notorie legat\u0103 de guvernarea prin OUG-uri (politici publice imprevizibile), problem\u0103 care a devenit \u0219i mai vizibil\u0103 \u00een timpul pandemiei.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Subminarea certitudinilor juridice<\/strong>: indiferent de domeniile acoperite de reglement\u0103rile de urgen\u021b\u0103, legiuitorii nu au reu\u0219it s\u0103 \u201ese asigure c\u0103 ini\u021biativele legislative nu submineaz\u0103 certitudinea juridic\u0103 prin \u00eembun\u0103t\u0103\u021birea calit\u0103\u021bii \u0219i predictibilit\u0103\u021bii lu\u0103rii deciziilor, inclusiv prin consult\u0103ri adecvate cu p\u0103r\u021bile interesate, evalu\u0103ri eficiente ale impactului \u0219i proceduri administrative simplificate \u201d.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Miza electoral\u0103<\/strong>: 2020 a fost \u0219i un an electoral, cu alegerile locale din 27 septembrie \u0219i alegerile generale din 6 decembrie. Lupta electoral\u0103 a subminat capacitatea de supraveghere a legislativului, multe dintre deciziile legate de pandemie devenind un teren pentru lupta politic\u0103 \u0219i mai pu\u021bin o conversa\u021bie despre cel mai potrivit r\u0103spuns.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Un Avocat al Poporului partizan?<\/strong> Rolul Avocatului Poporului ar fi trebuit s\u0103 aib\u0103 o importan\u021b\u0103 deosebit\u0103 \u00een acest context, deoarece este singura institu\u021bie capabil\u0103 s\u0103 atace imediat o ordonan\u021b\u0103 de urgen\u021b\u0103 c\u0103tre Curtea Constitu\u021bional\u0103. A f\u0103cut acest lucru \u00een ceea ce prive\u0219te unele limit\u0103ri ale drepturilor fundamentale, dar ac\u021biunile sale au fost acuzate de motivare politic\u0103.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Lipsa transparen\u021bei<\/strong>: reglement\u0103rile Covid-19 au adus limit\u0103ri accesului la informa\u021bii, transparen\u021ba \u0219i dialog social \u00eentr-un moment \u00een care semnificative vulnerabilit\u0103\u021bi ce \u021bin de corup\u021bie au fost generate de fondurile uria\u0219e alocate pentru a r\u0103spunde crizei sanitare. Organiza\u021biile societ\u0103\u021bii civile \u0219i jurnali\u0219tii au reac\u021bionat pe aceast\u0103 tem\u0103 \u0219i mai multe investiga\u021bii au ar\u0103tat c\u0103 riscurile de corup\u021bie s-au concretizat \u00een cazuri specifice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Acces slab la justi\u021bie<\/strong>: toate serviciile publice, inclusiv sistemul de justi\u021bie, au trebuit s\u0103 se adapteze la o cerere accelerat\u0103 de digitalizare. Cu toate acestea, resursele alocate pentru transformarea digital\u0103 (infrastructur\u0103, instruire etc.) nu s-au potrivit cu nevoile \u0219i accesul la serviciile publice, inclusiv accesul la justi\u021bie, au fost grav afectate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u00cen imaginea de ansamblu legat\u0103 de statul de drept \u00een Rom\u00e2nia, 2020 nu a adus prea multe evolu\u021bii pozitive:<br><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Schimb\u0103ri sistemice controversate<\/strong>: modific\u0103rile legale \u0219i politice semnificative, al\u0103turi de presiunea asupra sistemului judiciar \u00een 2017, 2018 \u0219i \u00een cea mai mare parte a anului 2019 au afectat eficien\u021ba, calitatea \u0219i independen\u021ba sistemului de justi\u021bie \u0219i capacitatea sa de a investiga \u0219i sanc\u021biona corup\u021bia la nivel \u00eenalt. Practicienii din sistemul judiciar \u0219i societatea civil\u0103 au reac\u021bionat puternic \u00eempotriva acestor schimb\u0103ri. Parteneri interna\u021bionali \u0219i europeni precum Comisia de la Vene\u021bia, GRECO sau Comisia European\u0103 au criticat, de asemenea, mai multe prevederi.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Probleme sistemice<\/strong>: chiar \u0219i \u00eenainte de acest punct, a\u0219a cum s-a men\u021bionat anual \u00een cadrul MCV, justi\u021bia rom\u00e2n\u0103 a avut-o probleme majore care au fost reflectate \u00een acuza\u021bii legate de influen\u021ba politic\u0103, de prevederile din codurile penale care au fost declarate neconstitu\u021bionale de CCR, de probleme de resurse umane, de o practic\u0103 judiciar\u0103 lipsit\u0103 de coeren\u021b\u0103, de rare investi\u021bii \u00een infrastructur\u0103, de durata lung\u0103 pentru procedurile \u00een instan\u021be etc.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Fapte, nu vorbe: <\/strong>at\u00e2t guvernul din 2020, precum \u0219i coali\u021bia de guvernare din 2021 au pretins \u00een timpul campaniei electorale c\u0103 vor sprijini ac\u021biunile de prevenire \u0219i sanc\u021bionare a corup\u021biei, manifest\u00e2ndu-\u0219i verbal dorin\u021ba de a anula unele dintre m\u0103surile adoptate \u00een 2017-2019. Cu toate acestea, nu s-au v\u0103zut progrese reale, iar Rom\u00e2nia nu a f\u0103cut \u00eenc\u0103 nimic din modific\u0103rile legislative necesare. \u00cen acest moment, nu este clar care e planul sau calendarul specific vizavi de schimb\u0103rile legate de justi\u021bie \u0219i lupta \u00eempotriva corup\u021biei. Dup\u0103 ce emo\u021biile electorale s-au disipat, se pare c\u0103 reforma sistemului judiciar nu mai este o prioritate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Lips\u0103 de \u00eencredere, haos, scandaluri<\/strong>: \u00cen 2021, sistemul judiciar rom\u00e2n e <em>no man&#8217;s land<\/em>. Niciuna dintre condi\u021biile preexistente care au fost folosite ca pretext pentru <a rel=\"noreferrer noopener\" href=\"https:\/\/republica.ro\/analiza-funky-citizens-asaltul-asupra-justitiei-cele-mai-daunatoare-modificari-la-codurile-penale\" data-type=\"URL\" data-id=\"https:\/\/republica.ro\/analiza-funky-citizens-asaltul-asupra-justitiei-cele-mai-daunatoare-modificari-la-codurile-penale\" target=\"_blank\">asaltul din 2017-2018<\/a> asaltul nu au fost rezolvate. Niciunul dintre efectele acestui asalt nu a fost atenuat. Ce este mai r\u0103u este c\u0103 cet\u0103\u021benii \u0219i societatea civil\u0103 par c\u0103<br>\u0219i-au pierdut \u00eencrederea \u00een capacitatea sistemul de justi\u021bie de a oferi dreptate.
