How do I obtain Romanian citizenship / right to have more than 1 citizenship in Romania?

https://cetatenie.md/dubla-cetatenie-in-romania/

Main:

All foreigners can apply for Romanian citizenship without losing the first one. Therefore, they become equal citizens of Romania. However, Romania does not have a special treaty on dual citizenship with any country. This means that having dual Romanian citizenship, a person undertakes to comply with the obligations of both legislations. Also, Romanian legislation does not require confirmation of the fact of dual citizenship.

With a Romanian passport, you become a citizen of the European Union.

This is possible in two ways: Naturalization and Repatriation.

Repatriation is a return to the Motherland, after a long, voluntary or forced absence. The basis is the presence of Romanian roots.

This program is simplified for persons whose ancestors were born on the territory of Greater Romania since 1918. Why exactly since 1918? The fact is that within the repatriation program of the Romanian Ministry of Justice, your relatives up to 3 generations are taken into account.

This fact can be confirmed by the following official documents:

      ✔️ Ancestor’s birth certificate;

      ✔️ Death certificate of an ancestor;

      ✔️Marriage certificate;

Naturalization. This program is longer and more difficult. It requires compliance with a number of conditions:

      ✔️ Permanent residence in Romania for at least 8 years. According to the legislation, the applicant undertakes to comply with all legal provisions, and also not to engage in any actions that violate order and national security;

      ✔️ No criminal record. In this case, offenses are taken into account not only on the territory of Romania, but also outside its borders;

      ✔️ Proficiency in the Romanian language at an appropriate level. You should also know the Constitution and the national anthem.

      ✔️ Availability of a permanent and sufficient source of income for a full existence. This condition is stipulated by the law “On the Regime of Foreign Citizens”;

To participate in the naturalization program, it is necessary to go through 3 stages:

      ✔️ The first – obtaining a residence permit and residence in Romania for at least 5 years; The basis for obtaining a residence permit can be: study, work, business or marriage.

      ✔️ The second is obtaining a permanent place of residence and living in the territory of Romania for at least 3 years;

      ✔️ The final stage is the submission of an application for a Romanian passport;

In the case of marriage with a Romanian citizen, the mandatory period of residence is shortened by 3 years, that is, you will have to stay in Romania for 5 years instead of 8 years.

Temporary protection

What is temporary protection?

On March 4, the Council of the EU unanimously adopted an executive decision on the introduction of temporary protection in connection with the mass entry of people fleeing Ukraine due to the war.

Temporary protection is an extraordinary mechanism. It can be applied when there is mass

influx of people This mechanism aims to provide immediate and collective (i.e. without

the need to consider individual applications) protection of displaced persons who are unable to return to their country of origin. The aim is to relieve pressure on national delivery systems

asylum and allow displaced persons to enjoy harmonized rights throughout European Union. These are housing rights, access to the labor market and housing, health care and access to education for children.

Who can benefit from temporary protection?

The temporary protection scheme applies to the following people if they were residing in Ukraine on or before 24 February 2022:

  • Ukrainian nationals and their family members
  • non-Ukrainian nationals and stateless persons benefiting from international protection in Ukraine (e.g. refugees and beneficiaries of subsidiary protection) and their family members
  • non-Ukrainian nationals with a permanent residence permit who cannot return to their country of origin in safe and durable conditions (adequate national protection can also apply)

What if someone falls outside these groups?

All people fleeing Ukraine, regardless of the category they come under, are granted access to the EU prior to returning to their place of origin.

What rights do beneficiaries have?

The temporary protection scheme allows displaced persons to enjoy harmonised rights across the EU:

  • residency rights
  • access to the labour market
  • access to housing
  • social welfare assistance
  • medical assistance

For unaccompanied children and teenagers:

  • legal guardianship
  • access to education

How long does temporary protection last?

The temporary protection was initially granted for one year and has already been extended until 4 March 2024. Depending on how the situation in Ukraine evolves it can be extended for another year, until March 2025.

Is temporary protection automatic?

The temporary protection is automatic but beneficiaries should apply for a residence permit in the EU country where they have decided to stay.

Is temporary protection only valid in one EU country?

Ukrainian nationals are visa-free travellers. Once admitted to EU territory, they can:

  • move freely for a 90-day period
  • choose the EU country in which they want to benefit from the temporary protection rights

Can beneficiaries apply for refugee status?

Being a temporary protection beneficiary does not preclude the possibility of applying for refugee status or other forms of protection available in EU countries.

To obtain temporary protection, it is necessary to apply for temporary protection to the authorities of the relevant EU country, which deal with migration issues. In Bucharest, this can be done at the UNHCR pavilion, which is located on the territory of Romexpo.
